The Contractor shall be responsible for all materials, equipment, and <br />supplies sold and delivered to the Owner under this Contract until final <br />inspection of the work and acceptance thereof by the Owner. In the <br />event any such material, equipment, and supplies are lost, stolen, <br />damaged, or destroyed prior to final inspection and acceptance, the <br />Contractor shall replace same without additional cost to the Owner. <br />I. Should the Contractor fail to take proper action on storage and handling <br />of equipment supplied under this Contract within seven days after <br />written notice to do so has been given, the Owner retains the right to <br />correct all deficiencies noted in previously transmitted written notice and <br />deduct the cost associated with these corrections from the Contractor's <br />Contract. These costs may be comprised of expenditures for labor, <br />equipment usage, administrative, clerical, engineering and any other <br />costs associated with making the necessary corrections. <br />1.07 SUBSTITUTIONS AND PRODUCT OPTIONS <br />07/03 <br />A. Products List: <br />1. Within 15 days after the effective date of the Agreement, submit <br />to the Engineer a complete list of major products proposed to be <br />used, with the name of the manufacturer and the installing <br />subcontractor. <br />B. Contractor's Options: <br />1. For Products specified only by reference standard, select any <br />product meeting that standard. <br />2. For Products specified by naming several products or <br />manufacturers, select any one of the products or manufacturers <br />named, which complies with the specifications, subject to the <br />base bid procedures outlined under Document 00400 - <br />Supplemental Bid Form. <br />3. For products specified by naming one or more Products or <br />manufacturers and "or equal ", Contractor must submit a request <br />as for substitutions for any Product or manufacturer not <br />specifically named. <br />C. Substitutions: <br />1. For a period of 15 days after the effective date of the Agreement, <br />the Engineer will consider written requests from Contractor for <br />substitution of Products. <br />2. Submit a separate request for each Product, supported with <br />complete data, with drawings and samples as appropriate, <br />01600 -5 03- 4138.A <br />
