' 15.5 The Surety Company shall submit verification from the Department of <br />Insurance Office of the Treasurer stating the surety company's license and <br />certificate of authorization to do business in the State of Florida. <br />' 16. SUBCONTRACTOR LIST <br />' 16.1 In conjunction with the Bid Form, Bidder shall submit a list of names of the <br />subcontractors and major material suppliers proposed for the principal <br />portions of the Work. Submit list on form provided by the Engineer. <br />16.2 Prior to award of Contract, the Owner will notify the Bidder in writing if they <br />have an objection to any person or entity listed. Upon such reasonable <br />' objection, the Bidder shall propose an acceptable substitute person or entity <br />in accordance with Article 6.06 of the General Conditions. <br />17. BID PROTEST <br />17.1 A notice of intent to award a contract ( "Notice of Intent to Consider Award ") <br />' shall be posted in the City Hall lobby not less than seven calendar days prior <br />to award of the contract by the City Commission. <br />' 17.2 After a Notice of Intent is posted, any actual bidder who is aggrieved in <br />connection with the pending award of the contract, or any element of the <br />process leading to the award of the contract, may protest to the City Manager <br />or his /her designee. A complete protest must be filed within five business <br />days after posting or any right to protest is forfeited. The protest must be in <br />writing on forms provided by the City, must identify the name and address of <br />' the protester, and must include a factual summary of, and the basis for, the <br />protest. Filing shall be considered complete when a completed protest form is <br />received by the City Manager or his /her designee and the required protest <br />' deposit (see paragraph (F) below) has been paid. <br />17.3 A protest committee shall have the authority to review the protest and <br />recommend to the City Commission whether to sustain or reject the protest. <br />The protest committee shall be comprised of the Director of Financial Services <br />(the "Director"), the City Manager or his /her designee, and the director or <br />designee of the department or office for which the contract is to be awarded <br />( "affected director "). The committee's review shall be informal. The Director, <br />or the affected director, shall serve as the chairperson of the committee. The <br />City Attorney or designee shall be counsel to the committee. <br />17.4 If the protest committee determines that the pending award of a contract, or <br />any element of the process leading to the award, involved a significant <br />violation of law or applicable rule or regulation, it shall recommend to the <br />City Commission that the protest be sustained. If the committee determines <br />' that the protest is without merit, the City Manager or his /her designee shall <br />issue a decision in writing stating the reason for the decision and furnish a <br />copy to the protester and any other interested party.
