<br />3.6 Materials, Labor, and Workmanship <br /> <br />3.6.1 Materials and equipment incorporated into the Work shall strictly conform to the Contract <br />Documents and representations and approved Samples provided by Contractor and shall be of <br />the most suitable grade of their respective kinds for their respective uses, and shall be fit and <br />sufficient for the purpose intended, merchantable, of good new material and workmanship, and <br />free from defect. Workmanship shall be in accordance with the highest standard in the industry <br />and free from defect in strict accordance with the Contract Documents. <br /> <br />3.6.2 Materials and fixtures shall be new and of latest design unless otherwise specified, and <br />shall provide the most efficient operating and maintenance costs to the City. All Work shall be <br />performed by competent workers and shall be of best quality. <br /> <br />3.6.3 The Contractor shall carefully examine the Contract Documents and shall be responsible <br />for the proper fitting of his material, equipment, and apparatus into the building. <br /> <br />3.6.4 The Contractor shall base his bid only on the Contract Documents. <br /> <br />3.6.5 Materials and workmanship shall be subject to inspection, examination, and test by the ME <br />and the City's Representative at any and all times during manufacture, installation, and <br />construction of any of them, at places where such manufacture, installation, or construction is <br />performed. <br /> <br />3.6.6 The Contractor shall enforce strict discipline and good order among the Contractor's <br />employees and other persons carrying out the Contract. The Contractor shall not permit <br />employment of unfit persons or persons not skilled in tasks assigned to them. <br /> <br />3.6.7 Unless otherwise specifically noted, the Contractor shall provide and pay for supervision, <br />labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, <br />transportation, and other facilities and services necessary for the proper execution and <br />completion of the Work. <br /> <br />3.7 Approved Equal <br /> <br />3.7.1 Whenever in the Contract Documents any article, appliance, device, or material is <br />designated by the name of a manufacturer, vendor, or by any proprietary or trade name, the <br />words "or approved equal," shall automatically follow and shall be implied unless specifically <br />indicated otherwise. The standard products of manufacturers other than those specified will be <br />accepted when, prior to the ordering or use thereof, it is proven to the satisfaction of the City's <br />Representative and the ME they are equal in design, appearance, spare parts availability, <br />strength, durability, usefulness, serviceability, operation cost, maintenance cost, and convenience <br />for the purpose intended. Any general listings of approved manufacturers in any Contract <br />Document shall be for informational purposes only and it shall be the Contractor's sole <br />responsibility to ensure that any proposed "or equal" complies with the' requirements of the <br />Contract Documents. <br /> <br />\.. <br /> <br />.... <br /> <br />13 <br />
