completion will be extended by the number of calendar days needed to include the excess <br />number of calendar days lost. <br /> <br />.4 acts of the public enemy, acts of the state, Federal or local government in its <br />sovereign capacity, and acts of another contractor in the performance of a contract with the City <br />relating to the Project. <br /> <br />The Contractor shall not be entitled to and hereby expressly waives any extension of time <br />resulting from any condition or cause unless said claim for extensions of time is made in writing <br />to the City and Design Consultant within seventy two hours of the first instance of delay. <br />Circumstances and activities leading to such claim shall be indicated or referenced in a daily <br />field inspection report for the day(s) affected; otherwise, all such claims are waived and released <br />by the Contractor. In every such written claim, the Contractor shall provide the following <br />information: <br /> <br />.1 Nature of the delay; <br /> <br />.2 Date (or anticipated date) of commencement of delay; <br /> <br />.3 Activities on the progress schedule affected by the delay, and/or new activities <br />created by the delay and their relationship with existing activities; <br /> <br />.4 Identification of person(s) or organization(s) or event(s) responsible for the delay; <br /> <br />.5 Anticipated extent of the delay; and <br /> <br />.6 Recommended actions to avoid or minimize the delay. <br /> <br />No change in Contract Amount will be authorized because of adjustment of Contract Time due <br />to unusually severe and abnormal, inclement weather (tornado, hurricane, typhoon or flood). <br /> <br />4.6.2 If abnormal weather conditions are the basis for a Claim for additional time, such Claim <br />shall be documented by the Contractor by data acceptable to the City's Representative <br />substantiating that weather conditions were abnormal for the period of time in question, and <br />could not have been reasonably anticipated, and that weather conditions had an adverse effect on <br />the scheduled construction, <br /> <br />PROVISION 5 <br />CHANGE ORDERS <br /> <br />5.1 The City, as authorized by its governing body, may authorize written Change Orders <br />regarding changes in, or additions to, Work to be performed or materials to be furnished pursuant <br />to the provisions of the Contract Documents. <br /> <br />) <br />23 I <br />
