Environmental <br />Based on the fact that the proposed project area is located within such an <br />environmentally sensitive environment, several permits will be required. <br /> <br />U.S. Armv Corps of Engineers Section 404 Permit <br /> <br />Since the proposed project will involve discharge of dredged and/or fill material <br />into wetlands/waters of the U.S., a Section 404 Clean Water Act Permit is <br />required prior to performing any work in these areas. The Corps will assess the <br />project in an effort to avoid and minimize wetland impacts and help determine the <br />mitigation requirements to compensate for wetland losses, protect water quality <br />and protect fish and wildlife resources. The Corps also administers and enforces <br />Section 10 of the Rivers and Harbors Act of 1899. Under Section 10, a Corps <br />permit is required for work or structures in, over and under navigable waters of <br />the United States. <br /> <br />South Florida Water Management District <br /> <br />The South Florida Water Management District (SFWMD) also has jurisdiction <br />over wetlands/waters of the U.S. occurring in the project area. The SFWMD <br />protects the supply and the quality of water resources by regulating the <br />management and storage of surface waters and the dredging or filling of wetlands. <br />If the proposed activities involve works in adjacent water bodies (e.g. Intracoastal <br />Waterway, Lake Okeechobee, etc.), the SFWMD will generally request a title <br />determination from the State of Florida as to whether the State has any claim to <br />the submerged lands. <br /> <br />The SFWMD and the Florida Department of Environmental Protection (FDEP) <br />have an Operating Agreement about which agency will process Environmental <br />Resource Permits for particular projects based on the type of land use. For <br />example, the SFWMD processes residential and commercial developments, while <br />the FDEP processes power plants, waste water treatment plants and single family <br />home projects. As such, this project will likely fall under the jurisdiction of the <br />SFWMD. <br /> <br />Miami-Dade County <br /> <br />Section 24-48 of the Miami-Dade County Code requires that a Miami-Dade <br />County Class I Permit be obtained prior to performing any work in, on, over or <br />upon tidal waters or coastal wetlands of Miami-Dade County or of any of the <br />municipalities located within Miami-Dade County. A Class I Permit is also <br />required for most mangrove trimming, alteration or removal. A Class I permit is <br />needed to manage impacts from construction on coastal wetlands and tidal <br />waters. Through the Class I Permit Application process, proposed projects are <br />reviewed to identify environmental and other impacts.
