DISPUTE DISCLOSURE -19.3 <br />Preliminary Statement: Waste Management Inc. of Florida ( "WMIF ") has operating <br />divisions throughout the State of Florida serving thousands of commercial customers and <br />many governmental entities. Accordingly, there has been litigation to interpret or enforce <br />the Company's solid waste service agreements between WMIF and its private customers, <br />most of which has been settled amicably. The vast majority of this litigation relates to <br />collection of amounts due pursuant to such agreements. Other litigation generally <br />concerns motor vehicle accidents, workers' compensation and employment issues; those <br />are not listed here. The following is a list of litigation that involves a governmental entity <br />and WMIF. The list also includes other litigation that is material. None of these matters <br />significantly impacts WMIF's ability to perform the work set forth in the instant <br />solicitation nor does it affect WMIF's normal business operations. <br />1) City of Tacksonville v. Waste Management Inc. of Florida, Circuit Court, 4� <br />Tudicial Circuit, Duval County, Case No. 01- 02030 -CA. This is a suit for alleged <br />noise violations. Settled. <br />2) Southern Waste Systems LLC v. Town of Davie and Waste Management Inc. of <br />Florida, US District Court for the Southern District of Florida, Case No. 05- 60847; <br />suit alleges that exclusive construction and demolition franchise violates the <br />Commerce Clause. Case was voluntarily dismissed by plaintiff. <br />3) Southern Waste Systems LLC v. Town of Lake Park and Waste Management Inc. <br />of Florida, US District Court for the Southern District of Florida, Case No. 05- <br />80174; suit alleges that exclusive construction and demolition franchise violates <br />the Commerce Clause. Case has been dismissed. <br />4) Southern Waste Systems LLC v. City of Coral Springs, Waste Management Inc. <br />of Florida, State of Florida, Florida Dept. of Environmental Protection, US <br />District Court for the Southern District of Florida, Case No.06- 61448 -CIV Gold; <br />suit alleges that exclusive construction and demolition franchise violates the <br />Commerce Clause. Summary judgment entered in favor of City, Broward County <br />and Waste Management Inc. of Florida. <br />5) Waste Management Inc. of Florida v. City of Lauderhill -Case No. 06- 014978 (12), <br />Circuit Court for 1701 Judicial Circuit, Broward County —file 2006; complaint for <br />collection of debt; settled. <br />6) Waste Services of Florida, Inc. v. City of Pinellas Park - Case No. 10- 1694 -CI -8, <br />Circuit Court, 6th Judicial Circuit, Pinellas County. WMIF is the exclusive <br />franchise hauler for the City. Plaintiff alleges that the exclusive C &D franchise is <br />improper. WMIF intervened. The case is pending. <br />7) FDS Disposal, Inc. et al v. City of Inverness and Waste Management Inc. of <br />Florida - Case No. 2009 -CA -4156, Circuit Court 5th Judicial Circuit, Citrus <br />County. Plaintiff alleged that renewal of franchise to WMIF was improper. <br />Summary judgment granted to WMIF and the City. <br />8) High Tide Harry's Inc. v. Waste Management Inc. of Florida - Case No. 05 -CA- <br />009441 - Circuit Court 9f Judicial Circuit, Orange County - Customer's claim <br />that billing was improper. Case settled. <br />
