9) Danner Construction Co. Inc. et al v. Hillsborough County, Florida -- Case No. <br />8:09 -CIV- 650- T- 17 -TBM, United States District Court, Middle District of Florida, <br />Tampa Division - Small hauler and commercial customer claim that the <br />franchise system in Hillsborough County violates antitrust laws (Florida and <br />US) because the County does not set rates for commercial work, instead allowing <br />the 3 franchised haulers (WMIF, Republic and Waste Services) to compete and <br />set rates by competition. Summary Judgment entered in favor or the County and <br />haulers. <br />There are no matters involving criminal actions, losses of service contracts with governmental <br />entities due to nonperformance or poor performance, bid bond or performance bond claims <br />during the past 5 years. <br />The above information is accurate to the best of WMIF's information and belief. Please note that <br />we have searched the records available to us which we have maintained in the ordinary course of <br />business.
