<br />.,-- <br /> <br />Wireless Data Services, Contract No. MA4974 with Verizon Wireless <br /> <br />Amendment No.9 <br /> <br />THIS AMENDMENT (number 9) ("Amendmenf') is made and entered into by and between the State of Florida, acting <br />by and through the Department of Management Services, Communication Information Technology Services <br />("Customer") and Verizon Wireless Personal Communications,LP (a DelawareLP) dba Verizon Wireless and Verizon <br />Wireless of the East LP dba Verizon Wireless, ("Contractor" or ''Verizon Wireless"), for attachment to Contract No. <br />MA4974, effective June 28, 2004 (the "Contracf'). <br /> <br />Customer and Verizon Wireless herebv al!ree to amend the Contract as follows: <br /> <br />1. This Amendment is an integral part of and modifies the Contract. The terms used herein which are defined or <br />specified in the Contract shall have the meanings set forth in the Contract. If there are any inconsistencies between <br />. the provisions of this Amendment and the provisions of the Contract and/or previous amendments, the provisions <br />of the Amendment number 9 shall contol. <br /> <br />2. Customer has replaced the entities previously identified in the Contract as the State Technology Office (STO) <br />and the Enterprise Information Technology Services (EITS). Customer shall pexform all the duties and obligations <br />and have the rights of bob STO and EITS as relates to the Contract. <br /> <br />3. Any use of the term "State CIO" in the Contract shall be replaced by the term "Secretary of the Department of <br />Management Services." <br /> <br />4. Se.ction 1.3 (Hierarchy of Documents )to the Contract is stricken in its entirety and replaced with the new section <br />below: <br /> <br />1.3 IDerarchv of Contract Documents. <br /> <br />The Contract consists of the following documents, which, in case of conflict, shall have priority in the <br />order listed: <br /> <br />. The 3 8-page contract document signed by Verizon Wireless on June 16, 2004 and by the State of <br />Florida on June 28, 2004, as subsequently amended. <br /> <br />. All Exhibits to the foregoing contract document, including any amendments. <br /> <br />. The IlN and any posted addenda relating thereto. <br /> <br />. Verizon Wireless' 37-page response to the IlN. <br /> <br />5. The next-to-Iast paragraph of Section 4.3.1 of the Contract is stricken in its entirety. (The stricken paragraph <br />begins with ''Verizon Wireless will remit. . ." and ends with ". . . that STO anticipates will utilize direct billing.") <br /> <br />6. Section 4.3 .1.1 (Cost Recovery Fee) to the Contract is stricken in its entirety and replaced with the new Section <br />below: <br /> <br />4.3.1.1 Administrative Fee: Customer shall have the right to charge Eligible Users a monthly <br />administrativefee (the" AdministrativeF ee") on each active line of service provided to the Eligible User <br />under this Contract. Customer shall solely determine the amount of the Administrative Fee.
