<br />INSTRUCTIONS TO BIDDERS <br /> <br />BID ON BLEACHER, PARK AND PLAYGROUND EQUIPMENT, 11-0014-MR <br /> <br />GENERAL BIDDERS INFORMATION: Interested vendors are advised that the School <br />District of Manatee County will not consider bids which contain an escalation clause for the <br />initial contract period. It is understood that normal bid processing time will be 30 - 60 days after <br />opening date of bid and that prices reflected by this bid will be firm through bid processing time <br />and the delivery of items awarded. <br /> <br />BIDDER'S LIABILITY: Bidders are expected to examine the specifications and all special and <br />general conditions, requirements and instructions. Negligence on the part of the bidder to make <br />the necessary examinations and investigations, or failure to fulfill, in every detail, the <br />requirements of the contract documents, will not be accepted as a basis for varying the <br />requirements of the district. Failure to follow the instructions contained in the bid for completion <br />of a bid response is cause for rejection of a bid. <br /> <br />PURCHASE TERMS AND CONDITIONS: This bid and the corresponding purchase orders <br />will constitute the complete agreement. The School District of Manatee County will not accept <br />proposed terms and conditions that are different than those contained in this Invitation for Bid, <br />including pre-printed text contained on catalogs, price lists, other descriptive information <br />submitted or any other materials. By virtue of submitting a bid, vendor agrees to not submit to <br />any School District of Manatee County employee, for signature, any document that contains <br />terms and conditions that are different than those contained herein and that in the event any <br />document containing any term or condition that differs from those contained herein is executed, <br />said document shall not be binding on the School District of Manatee County. <br /> <br />CANCELLATION: In the event any of the provisions of this bid/proposal are violated by the <br />vendor, the School District of Manatee County shall give written notice to the vendor stating the <br />deficiencies and unless deficiencies are corrected within five (5) days, recommendation will be <br />made to the School Board for immediate cancellation. The School Board of Manatee County <br />reserves the right to terminate any contract resulting from this invitation at any time and for no <br />reason, upon giving thirty (30) days prior written notice to the other party. <br /> <br />.... <br /> <br />Page 3 of37 <br />
