<br />Instructions to Bidders - continued <br />Bid on Bleacher, Park and Playground Equipment, MCSD No. 11-0014-MR <br /> <br />POSSESSION OF FIREARMS: Possession of firearms will not be tolerated on the project or <br />any School District of Manatee County property. No person who has a firearm in their vehicle <br />may park their vehicle on School District property. Furthermore, no person may possess or bring <br />a firearm on School District property. If any employee or independent contractor of the <br />vendor/bidder, or any of its sub-contractors, is found to have brought a firearm on School <br />District property, said employee or independent contractor shall be immediately removed and <br />terminated from the project by the vendor/bidder. If a sub-contractor fails to terminate said <br />employee or independent contractor, the vendor/bidder shall terminate its agreement with the <br />sub-contractor. If the vendor/bidder fails to terminate said employee or independent contractor <br />or fails to terminate the agreement with the sub-contractor who fails to terminate said employee <br />or independent contractor, this agreement may be terminated by the School District of Manatee <br />County. "Firearm" means any weapon (including a starter gun or antique firearm) which will, is <br />designed to, or may readily be converted to expel a projectile by the action of an explosive, the <br />frame or receiver of any such weapon, any destructive devise, or any machine gun. Powder <br />actuated construction nailers and fasteners are excluded from this definition. <br /> <br />CRIMINAL ACTS: Employment on the project by the Vendor/Bidder, or any of its <br />subcontractors, of any employee, or independent contractor, with any prior convictions of any <br />crimes against children, crimes of violence or crimes of moral turpitude will not be tolerated. If <br />it is determined that any person with such criminal history is on the project site, the <br />Vendor/Bidder agrees to take all steps necessary to remove such person from the project and the <br />property. The School District of Manatee County shall have the right to terminate this agreement <br />if the Vendor/Bidder does not comply with this provision. <br /> <br />SEXUAL PREDATORS/JESSICA LUNSFORD ACT: Beginning September 1, 2005, vendors, <br />individuals or entities under contract with the School Board of Manatee County who are <br />permitted access on school grounds when students are present and must comply with section <br />1012.465, Florida Statutes, must meet Level 2 screening requirements as described in Section <br />1012.32 Florida Statutes. Subsection (3 of Section 1012.465) states, "If it is found that a person <br />who is employed or under contract in a capacity described in Subsection (1) does not meet the <br />Level 2 requirements, the person shall be immediately suspended from working in that capacity <br />and shall remain suspended until the final resolution of any appeals." Vendors, individuals or <br />entities under contract with the School Board of Manatee County required to go on school <br />grounds when students are present, must comply with the requirements of the law and <br />agree to indemnify and hold harmless the School Board of Manatee County for any claims <br />made against the School Board related to the failure to comply with Section 1012.465. <br /> <br />Page 70f37 <br /> <br />.~ <br />
