<br />Instructions to Bidders - continued <br />Bid on Bleacher, Park and Playground Equipment, MCSD No. II-OOI4-MR <br /> <br />MINIMUM ORDER: Bids reqUIrIng mInImUm quantity and/or dollar purchases will be <br />considered only if determined to be in the best interest of the School District. <br /> <br />DEF AUL IS: If the Bidder defaults after the Board awards a bid, the Bidder shall pay to the <br />School District of Manatee County, as liquidated damages, an amount equal to five percent (5%) <br />of the unit prices times the quantity of each item in question, or $25.00, whichever amount is <br />larger. If the bid pricing was expressed as a lump sum amount, the amount due will be five <br />percent (5%) of the remaining value of the contract. A successful bidder who fails to pay said <br />liquidated damages within fifteen (15) days after notification that liquidated damages are due, <br />shall lose eligibility to transact business with the School District of Manatee County for a period <br />of not less than one (1) year, but no more than two (2) years after the date of the default. <br />Thereafter, the bidder may request to be reinstated to the active vendor list(s). <br /> <br />In addition, failure of any delivered item to conform to specifications as bid shall constitute a <br />default in the contract and shall be subject to return or replacement at the buyer's option. Failure <br />to deliver one (1) or more items on two (2) or more consecutive deliveries will be viewed as <br />delivery default and will be considered grounds for canceling all awarded items and sites. <br />Penalties may be assessed when failure to deliver places a financial burden on the School Board. <br /> <br />USE OF OTHER CONTRACTS: The School Board of Manatee County reserves the right to <br />utilize any other School District of Manatee County contract, any State of Florida contract, any <br />contract awarded by any other city or county governmental agencies, other school board, other <br />community college/state university system cooperative bid agreement, or to directly <br />negotiate/purchase per School Board policy and/or State Board Rule 6A-1.012, as currently <br />enacted or as amended from time to time, in lieu of any offer received or award made as a result <br />of this bid if it in its best interest to do so. <br /> <br />Page I I of37 <br /> <br />"' <br />\ <br />
