<br />checked by and stamped with the approval of the Contractor, identified clearly as to material, <br />manufacturer, any pertinent catalog numbers and the use for which intended. <br /> <br />5.25.2. At the time of each submission, the Contractor will in writing call the Consultant's attention to <br />any deviations that the Shop Drawings or sample may have from the requirements of the <br />Contract Documents. <br /> <br />5.25.3. The Consultant will review with responsible promptness Shop Drawings and Samples, but their <br />review shall be only for conformance with the design concept of the Project and for compliance <br />with the information given in the Contract Documents. The review of a separate item as such <br />will not indicate review of the assembly in which the items functions. The Contractor will make <br />any corrections required by the Consultant and will return the required number of corrected <br />copies of Shop Drawings and resubmit new samples until the review is Consultant on previous <br />submissions. The Contractor's stamp of approval on any Shop Drawings or sample shall <br />constitute representation to the City and the Consultant that the Contractor has either <br />determined and verified all quantities, dimension, field construction criteria, materials, catalog <br />numbers and similar data or they assume full responsibility for doing so, and that they have <br />reviewed or coordinated each Shop Drawing to sample with the requirements of the Work and <br />the Contract Documents. <br /> <br />5.25.4. No Work requiring a Shop Drawing or sample submission shall be commenced until the <br />submission has been reviewed by the Consultant. A copy of each Shop Drawing and each <br />approved sample shall be kept in good order by the Contractor at the site and shall be available <br />to the Consultant. <br /> <br />5.25.5. The Consultant's review of Shop Drawings or samples shall not relieve the Contractor from their <br />responsibility for any deviations from the requirements of the Contract Documents unless the <br />Contractor has in writing called the Consultant's attention to each deviation at the time of <br />submission and the Consultant has given written approval to the specific deviation, nor shall any <br />review by the Consultant relieve the Contractor from responsibility for errors or omission in the <br />Shop Drawings. <br /> <br />5.26. Cleaning up: The Contractor shall clean up behind the Work as much as is reasonably possible <br />as the Work progresses. Upon completion of the Work, and before acceptance of final payment for the <br />Project by the City, the Contractor shall remove all their surplus and discarded materials, excavated <br />material and rubbish from the roadways, sidewalks, parking areas, lawn and all adjacent property; shall <br />restore all property, both public and private, which has been disturbed or damaged during the <br />prosecution of the Work; and shall leave the whole in a neat and presentable condition. If the Contractor <br />does not clean the Work site, the City may remove the rubbish and charge the cost to the Contractor. <br /> <br />5.27. Public Convenience and Safety: The Contractor shall, at all times, conduct the Work in such <br />a manner as to insure the least practicable obstruction to public travel. The convenience of the general <br />public and of the residents along and adjacent to the area of Work shall be provided for in a satisfactory <br />manner, consistent with the operation and local conditions. During the day, access to private property <br />shall be for short durations, if at all, and in the evening, access to private property shall always be <br />available. <br /> <br />5.28. Indemnification: In consideration of the separate sum of twenty-five dollars ($25.00) and <br />other valuable consideration, the Contractor shall indemnify, defend and save harmless the City, its <br />officers, agents or employees from or on account of any injuries or damages, received or sustained by <br />any person or persons during or on account of any operations connected with the construction of this <br />Project, or by or in consequence of any negligence (excluding the sole negligence of City, officers, agents <br />or employees), in connection with the same; or by use of any improper materials or by or on account of <br /> <br />PAGE 21 OF 130 <br />BID No. 08-10-01 <br />
