<br />be required by safety provisions of applicable laws, ordinances, rules regulations and <br />building and construction codes. <br /> <br />3.2.9 During the performance of the Work, the Contractor shall be responsible for providing <br />and maintaining warning signs, lights, signal devices, barricades, guard rails, fences, and <br />other devices appropriately located on site which shall give proper and understandable <br />warning to all persons of danger of entry onto land, structure, or equipment. <br /> <br />3.2.10 The Contractor shall be responsible for care of the Work and must protect same from <br />damage of defacement until acceptance by the City. All damaged or defaced Work shall <br />be repaired or replaced to the City's satisfaction, without cost to the City. <br /> <br />3.2.11 When requested by the City's Representative, the Contractor, at no extra charge, shall <br />provide scaffolds or ladders in place as may be required by the AlE or the City for <br />examination of Work in progress or completed. <br /> <br />3.2.12 The Contractor shall be responsible to the City for acts and omissions of the Contractor's <br />employees, Subcontractors of any tier and their agents and employees, and any entity or <br />other persons performing portions of the Work. <br /> <br />3.2.13 The Contractor shall not be relieved of its obligations to perform the Work in accordance <br />with the Contract Documents either by activities or duties of the City's Representative or <br />AlE in their administration of the Contract, or by tests, inspections or approvals required <br />or performed by persons other than the Contractor. <br /> <br />3.2.14 The Contractor shall be responsible for inspection of portions of the Work already <br />performed under this Contract to determine that such portions are in proper condition to <br />receive subsequent Work. <br /> <br />3.2.15 Job site safety is the responsibility of the Contractor. Any costs associated with providing <br />a safe construction site, including staging areas, per all State, Federal, City and OSHA <br />regulations are included in the bid price submitted. <br /> <br />The Contractor shall take all reasonable precautions for the safety of, and shall provide <br />all reasonable protection to prevent damage, injury or loss to: <br /> <br />· all employees on the Work and all other persons who may be affected thereby; <br /> <br />· all the Work and all materials and equipment to be incorporated therein, whether <br />in storage on or off the site, under the care, custody or control of the Contractor <br />or any of his Subcontractors or Sub subcontractors, machinery, equipment and <br />all hazards shall be guarded or eliminated in accordance with all applicable <br />safety regulations; and <br /> <br />· other property at the site or adjacent thereto, including trees, shrubs, lawns, <br />walks, pavements, roadways, structures and utilities not designated for removal, <br />relocation or replacement in the course of construction. <br /> <br />3.2.16 OSHA Safety - OSHA 1926 Construction Standard. <br /> <br />3.2.16.1 <br /> <br />The Contractor shall give all notices and comply with all applicable laws, <br />ordinances, permits, rules, regulations and lawful orders of any public <br />authority bearing on the safety or persons or property or their protection <br />from damage, injury or loss. Contractors shall comply with the <br />requirements of the Trench Safety Act, Chapter 553, Florida Statutes. <br /> <br />10 <br />
