The Trench <br />Safety Compliance Act Form is located in Section B of this bid package. <br /> <br />The Contractor shall at all times safely guard the City's property from <br />injury or losses in connection with the Contract. Contractor shall at all <br />times safely guard and protect work and adjacent property from damage <br />as provided by law and the Contract Documents. All passageways, <br />guard fences, lights and other facilities required for protection by <br />applicable safety regulations must be provided and maintained by the <br />Contractor. <br /> <br />The Contractor shall erect and maintain, as required by existing <br />conditions and progress of the Work, all reasonable safeguards for <br />safety and protection, including posting danger signs and other warnings <br />against hazards, promulgating safety regulations and notifying Citys and <br />users of adjacent utilities. <br /> <br />When the use or storage of explosives or other hazardous materials or <br />equipment is necessary for the execution of the Work, the Contractor <br />shall exercise the utmost care and shall carry on such activities under <br />the supervision of properly qualified personnel. <br /> <br />Asbestos Assessment applies to renovation/construction of existing <br />bu i Idi ngs/structu res. <br /> <br />Material Safety Data Sheets <br />a. Any Contractor bringing chemicals on-site must provide the City <br />the appropriate hazard information on these substances, <br />including the labels used and the precautionary measures being <br />taken in working with these chemicals. <br /> <br />The Contractor shall promptly remedy, at the Contractor's own cost and <br />expense, all damage or loss to any property caused in whole or in part <br />by the Contractor, any Subcontractor, any Sub subcontractor, or anyone <br />directly or indirectly employed by any of them, or by anyone for whose <br />acts any of them may be liable and for which the Contractor is <br />responsible. The foregoing obligations of the Contractor are in addition to <br />obligations under the agreement. In case of failure on the part of the <br />Contractor to make good such damage, the City may, upon two (2) <br />calendar days written notice, proceed to repair, rebuild or otherwise <br />restore such property as may be necessary, and the cost thereof will be <br />deducted from any monies due or to become due the Contractor. <br /> <br />The Contractor is responsible for the proper packing, shipping, handling <br />and storage (including but not limited to shipment or storage at the <br />proper temperature and humidity) of materials to be incorporated in the <br />Work, so as to insure the preservation of the quality and fitness of the <br />material for proper installation and incorporation in the Work. For <br />example, but not by way of limitation, Contractor shall, when necessary, <br />place material on wooden platforms or other hard and clean surfaces <br />and not on the ground, and place material under cover in any appropriate <br />shelter or facility.
