Summary Minutes: Regular City Commission Meeting

April 21, 2011

City of Sunny Isles Beach, Florida

Vice Mayor Thaler asked how many docking spaces we have, and Ms Simpson said the
"Princess" Yacht is taking up two spaces, and so technically we have four left, one was
damaged but it will be repaired. As a point of clarification, in the RFP we included that
during construction they must allow access for anyone who is going to be utilizing the docks.

Commissioner Scholl moved and Commissioner Aelion seconded a motion to approve this
resolution. Resolution No. 2011-1701 was adopted by a voice vote of 5-0 in favor.

10D. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving a
Street Lighting Agreement with Florida Power and Light (FPL) for the Removal of26
Concrete Streetlight Poles and 27 Light Fixtures Within the Central Island Area, in an
Amount Not to Exceed $29,487.15, Attached Hereto as Exhibit "A"; Authorizing the Mayor
to Execute Said Agreement; Authorizing the City Manager to Do All Things Necessary to
Effectuate this Resolution; Providing for an Effective Date.

Action: City Clerk Hines read the title, and Public Works Director Gio Batista reported that
this Agreement allows us to complete the beautification for the Central Island area where we
have already done some street and roadway improvements. There are still some concrete
light poles out there that are going to be removed, and the execution ofthis Agreement would
allow FPL to move in and begin the process of removing those poles.

Public Speakers: none

Vice Mayor Thaler said after we finish here we should have FPL look at the rest of our City
and take down poles throughout all of Sunny Isles Beach. Mr. Batista said that this morning
he put together a transmittal to FPL requesting additional information as to who owns certain
poles so we can start picking out those poles that should/can be removed if they don't fall
under another undergrounding project, and we are going to be targeting those poles.

Mayor Edelcup said at the Workshop we had earlier this week, he had asked staff for an
update on the entire undergrounding project that was supposed to be a 10-year project 14
years ago and we are nowhere near the completion. But it would be good if staff would
present an update as to where we stand, where we need to go, and the projected time
references that we can use to guide us in the future as to when the City will be completely
underground and all the overhead poles taken down.

Commissioner Scholl asked if the removal of the Atlantic Island poles is in the current
contractor's agreement or are we relying on FPL to remove the poles when the last house is
hooked up, and Mr. Batista said that FPL will be removing those poles. When all the homes
are energized and their contractor comes in and makes the connection, FPL will be pulling
the permit. We have been in contact with them and they will be coming in quickly to do that.

Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve this
resolution. Resolution No. 2011-1702 was adopted by a voice vote of 5-0 in favor.

7
