Hines, CMC, City Clerk <br /> <br />MEMORANDUM <br /> <br />TO: The Honorable City Commissi n <br /> <br />FROM: Hans Ottinot, City Attorney <br /> <br /> <br />DATE: September 15,2011 <br /> <br />RE: Ordinance Prohibiting the Use of Air Rights for Development Purposes <br /> <br />RECOMMENDATION <br /> <br />This Ordinance is presented for your consideration. <br /> <br />REASONS <br /> <br />Several years ago, the City Commission created the Transfer of Development Rights program <br />("TOR program") to provide for greater flexibility in the pattern of development by allowing for <br />the transfer of development rights from one property to another property to create more green <br />space in the City. The purpose of the attached Ordinance is to reaffirm and clarify that the TDR <br />program is the only mechanism that permits the transfer the development rights from one <br />property to another property. In other words, air rights (also known as unused development <br />rights on an existing developed property) cannot be used for development purposes under the <br />City Code. Moreover, the amendatory Ordinance requires notice to the City when private parties <br />agree to purchase air rights regarding a particular property. <br />
