<br />Regular City COmmission Meeting <br /> <br />June 3, 2004 <br /> <br />City of Sunny Isles Beach, Florida <br /> <br />Public Speakers: none <br /> <br />Vice Mayor Goodman asked if in the construction of the huilding if they are making <br />preparations for these wIres to he put in, and Mr. Arias said he did a site visit with <br />Planning and Zoning Administrator Jorge Vera and the vendor, and the Project Manager <br />on site from Weitz said they Would be ready for the vendor to begin cabling in <br />approximately two weeks. Mayor Edelcup asked if we have provision in the Contract to <br />make sure they deliver timely, City Manager Russo said tbey are paid monthly and that <br />their work should be completed within two to three months. Commissioner Brezin asked <br />about the eqnipment and Mr. Arias said we will have a 25-year warranty from the <br />manufacturer. <br /> <br />Vice Mayor Goodman moved and Commissioner Thaler seconded a motion to approve <br />the resolution. Resolution No. 2004-680 was adopted by a voice vote of 5-0 in favor. <br /> <br />9B. PUBLIC HEARING <br />A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, <br />Accepting the Conveyance of Approximately 3.46 Acres of Real Property (The <br />"Casino Property"), Legally Described on Attachment "A," Attached and InCOJ]Jorated, <br />and With a Street Address of 17200 Collins A venue and Owned by 17200 Collins <br />A venue, Ltd ("Applicant"), in Accordance with and Subject to All of the Applicable <br />Provisions of the City Code and Section 265-23 of the City's Land Development <br />Regulations ("LD Rs") Relating to Transfers of Development Rights ("TDRs "), Including <br />bnt Not Limited to Sections 265-23.3 (c) and (e) and Section 265-23.4(c); Further <br />Conditioning Said Acceptance Upon the Following: (1) Applicant Shall IndemniJY, <br />Protect and Hold the City Hannless; (2) Applicant Shall Deliver to the City Good, <br />Marketable and Insurable Title, Free and Clear of All Liens and Encumbrances, and an <br />Acceptable Title COmmitment; (3) The Warranty Deed by Which the Sender Site is <br />COnveyed to the City Shall be Held in Escrow by the City Pending Approval by the City <br />Commissi on; (4) The Warranty Deed Shall be Recorded in the Public Records of Miami- <br />Dade County, FlOrida, Prior to Transfer of Development Ri ghts from the Sender Si te to <br />the fiR Bank; (5) Applicant Shall Submi t an Up-to-Date Survey of the Casino Property <br />Dated No Later Than 30 Days Prior to the Recording of the Deed; and (6) Execution by <br />Applicant of Any Other Documents as Deemed Appropriate by the City Attorney; (7) <br />Prior to the WithdraWal of the fiR'S from the fiR Bank, Applicant Shall Provide <br />Security for the Funding of Park and Public Improvements or Shall Agree to Construct <br />Park and Public Improvements; Further Authorizing the City Manager to Execute Such <br />Other Documents and Agreements as May be Determined by the City Attorney to be <br />Necessary to Consummate the Conveyance of the Casino Property to the City, Sever <br />Development Rights from the CaSino Property and Deposit Same to the Credit of the <br />Applicant in the TDR Bank, Snbseqnent Withdrawal of Said Development Rights at the <br />Request of and for the Benefit of the Applicant as May be Approved by the City <br /> <br />9 <br />
