<br />During the preliminary investigation an employee may be placed on leave with pay, if <br />applicable, or removed from safety sensitive assignments/positions. After the <br />preliminary investigation in completed, but in no event later than 15 days after the <br />employee's department head learns of the arrest, normal personnel procedures shall be <br />implemented. <br /> <br />XII. Confidentiality <br /> <br />All information, interviews, reports, statements, memoranda and drug test results, written or <br />otherwise, received by the City as a part of this drug testing program are confidential <br />communications. Unless required by state or federal laws, rules or regulations, the City will <br />not release such information without a written consent form signed voluntarily by the person <br />tested, except when consulting with legal counsel in connection with action brought under or <br />related to S 440.101-102, or when the information is relevant to the City's defense in a civil <br />or administrative matter. <br /> <br />XIII. Records And Training <br /> <br />A. Resource File <br /> <br />The City will maintain a current resource file of providers of employee assistance including <br />alcohol and drug abuse programs, mental health providers, and various other persons, <br />entities or organizations designed to assist employees with personal or behavioral problems. <br />The City will inform employees and new hires about various employee assistance programs <br />that the employer may have available. The information shall be made available at a <br />reasonable time convenient to the City in a manner that permits discreet review by the <br />employee. The City will provide the names, addresses, and telephone numbers of <br />employee assistance programs and local alcohol and drug rehabilitation programs to <br />employees and applicants. <br /> <br />B. Individual Test Results <br /> <br />1. The MRO shall be the sole custodian of individual positive test results. <br /> <br />2. The MRO shall retain the reports of individual positive test results for a period of five <br />years. <br /> <br />3. The City shall keep confidential and retain for at least one year an employee's <br />challenge or explanation of a positive test result, the City's response thereto, and the <br />report of positive result. <br /> <br />4. The City shall keep all negative test results for five years. <br /> <br />C. General Records of the City of Sunny Isles Beach <br /> <br />1. Records which demonstrate that the collection process conforms to all appropriate <br />state or federal regulations shall be kept for three years. <br /> <br />2.
