<br />event that the Applicant has done so and prior to issuance of the Certificate of Occupancy <br />the Applicant shall acquire the following floor area ratio bonuscs: <br /> <br />a) Beach Access Trust Fund Bonus 0.30 FAR $ 450,144 <br />b) Public Beach Rec. Enhancement 0.60 FAR $ 900,288 <br />c) Collins Ave. Streetscape 0.60 FAR $ 900,288 <br />d) Sunny Isles Public Parking 0.20 FAR $ 300,096 <br />e) Public Recreational Open Space 0.20 FAR $ 300,096 <br />t) Educational and Cultural 0.20 FAR $ 300,096 <br /> <br />The total contribution for all Floor Area Ratio bonuses for the development is $3,151,008.00 <br />for a total increase in floor area ratio of 2.1 for a area ratio of 4.6. A payment of <br />$3,151,008.00 is required prior to the issuance of a building permit. <br /> <br />10. That in the event of multiple ownership, a homeowner's association be established in <br />accordance with applicable regulations to assure that all common areas and facilities for the <br />residents, as well as all easements dedicated to the City, shall be maintained in continuous <br />and satisfactory manner and without expense to the general taxpayers of the City of Sunny <br />Isles Beach. <br /> <br />II. That the Applicant comply with all conditions and pcrmit requirements, including but not <br />limited to Miami-Dade County, including environmental conditions and permitting, the Fire <br />and Water and Sewer Departments, Florida Department of Environmental Protection (DEP) <br />and Florida Department of Transportation (FOOT). <br /> <br />12. No building permits shall be issued (except for demolition and sales trailers) unless the <br />Applicant has submitted all documents referred to under this approval and shall have paid <br />all impact fees, bonuses, and Transfer of Development Rights (if applicable), professional <br />fees (as per Ordinance 2001-132 and such othcr applicable Land Development Regulations) <br />due to the City. <br /> <br />13. The Applicant submits voluntarily and freely the $25,000 donation to the Sunny Isles Beach <br />K-8 Trust Fund for scholarship purposes as part of the mitigation impact to waive the beach <br />access easement requirement. The total mitigation amount shall be paid within three (3) <br />working days of approval of the site plan application. <br /> <br />14. That the Applicant shall relocate upon request by the City all sand excavated from the <br />property including sand from the western side of the Coastal Construction Control Line <br />("CCCL"). The sand shall be placed on the beach in Sunny Isles Beach for re-nourishment <br />purposes in a location to be determined by Miami-Dade County. <br /> <br />15. That the Applicant shall enter into a License Agreement with the City within fifteen (15) days <br />of issuance of this Resolution for the use of limited area on the north side of Samson <br />Oceanfront Park for staging purposes. The Applicant shall provide the City with the <br />appropriate compensation for the use of Samson Oceanfront Park. The City reserves the right <br />to reject a License Agreement if fair market compensation is not provided to the City. <br /> <br />16.
