<br />shall have paid all other fees due to the City. <br /> <br />17. If approved, the Applicant must submit a separate building permit prior any installation of <br />murals or graphics on temporary construction fencing to be approvcd administratively by the <br />City Manager or designee. <br /> <br />18. That the Applicant shall relocate existing trees on the property to areas designated by the <br />City upon request. <br /> <br />19. That the Applicant agrees to construct a decorative band shell at Samson Oceanfront Park or <br />at a park designated by the City Manager or designee. The City shall provide noticc to the <br />Applicant as to the location of the band shell. The band shell is required to be designed and <br />constructed similar to the band shell or stage at Heritage Park unless instructed otherwise by <br />the City. Thc design and construction of the band shell is subject to the approval of the City <br />Manager or designee and the design shall be submitted to the City Manager prior to the <br />issuance of a building permit. In lieu of constructing a band shell, the City may accept <br />compensation under the License Agreement or a cash contribution for the design and <br />construction costs. <br /> <br />B. CONDITIONS TO BE COMPLETED BEFORE ANY CERTIFICATE OF <br />OCCUPANCY IS ISSUED. <br /> <br />20. The Applicant agrees to proffer certain public improvements including; (i) the <br />redevelopment of the north portion of Samson Oceanfront Park with new playground <br />equipment, landscaping, paved walkway and decorative paver sidewalk in front of Samson <br />Oceanfront Park; and (ii) installation of decorative paver sidewalk in front of the subject <br />property as well as in front of the Monaco Motel (Travelodge), as part of the as part of the <br />mitigation impact to waive thc beach access easement requircment. The decorative paver <br />shall be identical to the decorative pavers installed by the City in accordance with the <br />Streetscape Master Plan. The public improvements set forth in this paragraph shall be <br />approved by the City Manager or designee bcfore installation. <br /> <br />21. That the Applicant demonstrates that they are in compliance with all terms and conditions <br />under this approval. <br /> <br />22. The Applicant shall pay all fees related to the review of the application dcscribed herein and <br />shall have paid all other fees due to the City. <br /> <br />23. Under Ordinance 2001-132, the City Manager and/or his/her designee in review of any <br />application, may refer any such application presented to it to such engineering, planning, <br />legal, technical, or environmcntal consultant or professional(s) employed by the City as the <br />Manager shall deem reasonably necessary to enable him/her to review such application as <br />required by law. Charges made by such consultants or professionals shall be in accord with <br />the charges customarily made for such services in Miami-Dade County, and pursuant to an <br />existing contractual agreement by and between the City and such consultant.
