<br /> This Fourth Amendment to the Agreement between the CITY OF SUNNY ISLES BEACH
<br /> ("City") and R.J. BEHAR & COMPANY, INC., ("Consultant") executed this - day of
<br /> ke, ,201'!1,is made a part of the original.Agreement between the parties dated April
<br /> 2014,Con act No.C1314-047("the Agreement"),betw,e,enthe C4y and Consultant attached hereto as
<br /> Attachment "B" whose Federal Identification # is COQ ' O 010 . The City and
<br /> Consultant hereby agree as follows:
<br /> . _ . 1. . ADDITIONAL SCOPE. Section 2 of the original Agreement.is:hereby amended-to include. .
<br /> additional engineering and architecturalservices for improvements at Samson Oceanfront Park related to
<br /> site lighting-modifications and FDEP.permit procurement, ("Additional Services"), as set forth in the
<br /> Consultant's proposal,a'copy of which is attached hereto and incorporated herein as Attachment"A".
<br /> 2. ADDITIONAL COMPENSATION. The total contract amount;mostrecently increased via the
<br /> Third Amendment to the Agreement,approved by.the City Commission via Resolution No.2015-2471,on
<br /> • October 15,2015,for a total amount not to exceed Four Hundred Six Thousand Two Hundred Seventy Five
<br /> Dollars:and Fifty Cents ($406,275.50), is hereby amended to include Additional Compensation for the
<br /> Additional Services in an amount.not to exceed Eighty Two. Thousand. Five Hundred Fifty Dollars
<br /> ($82,550.00),bringing the totalcontract amount not to exceed Four Hundred Eighty Eight.Thousand Eight
<br /> Hundred Twenty Five Dollars and Fifty Cents($488,825.50).
<br /> .3. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, all
<br /> terms and conditions of the original Agreement between the parties dated April 17,2014,shall remain in
<br /> full force and effect.
<br /> •
<br /> 4. CONFLICTING PROVISIONS. The terms, statements, requirements,or provisions contained
<br /> in this Fourth Amendment shall prevail and be given superior effect and priority over any conflicting or
<br /> inconsistent terms,statements,requirements or provisions contained in any other document or attachment,
<br /> including but not limited to Attachments"A"and`B":
