Applicant will honor the qualifications and priority for participation as <br /> outlined in Section 265-39(F) and 265-39(G) for police officers and general employees of the City, <br /> Miami-Dade County school employees, and employees working for licensed businesses in the City. <br /> Applicant will provide an annual report to the City Manager demonstrating compliance, in <br /> accordance with Section 265-39(H). Further, Applicant will provide a Restrictive Covenant, which <br /> guarantees the availability of workforce housing for a period of thirty (30) years; and will comply <br /> with the additional requirements listed in Section 265-39. <br /> In sum, the Proposed Project complies with the Waterfront Development Bonus and <br /> Workforce Housing Bonus, for a total permitted density of 68 units per acre, or 589 units on the <br /> Property. <br /> Art in Public Places <br /> Applicant is proposing to provide two (2)water features, one(1)fountain at each of the new <br /> towers, leading to the baywalk (at a cost of $50,000.00 each). Applicant will also provide five (5) <br /> Bougainvillea Trellis_Sculptures as follows: one (1) located at-the-North-Tower within the baywalk <br /> area, two(2) located along Kings Point Drive, and two (2) located at the South Tower in the garden <br /> park area(at a cost of$7,000.00 each). Therefore, Applicant is proposing to provide approximately <br /> $135,000.00 of art on site. Applicant may propose additional artwork on site, of approximately <br /> $365,000.00; or alternatively Applicant will pay the remainder into the Public Art Fund. <br /> Variances: <br /> Although the Property is an irregularly shaped lot, the Proposed Project meets all <br /> requirements under the City's Land Development Regulations ("LDRs") including height, FAR, <br /> parking and density, with the exception of setback encroachments and building separation <br /> requirements, for which Applicant requests the following variances: <br /> • Parking Garage Setbacks: The Property is unique because it is composed of <br /> irregularly shaped parcels on one of the City's finger islands. Significantly, the <br /> Property narrows towards the middle of the lot, where the setback relief is being <br /> requested. Specifically, Applicant is requesting a side setback of approximately <br /> 13'2°, on the southern portion of the Parking Garage (Kings Point Drive) where 25 <br /> feet are required; and requesting a side setback of approximately 16'11° on the <br /> northern portion of the Parking Garage(Waterway),where 25 feet are required. <br /> • Porte Cochere Setbacks: The Proposed Buildings meet the setback <br /> requirements. However, each of the Proposed Buildings contain a proposed Porte <br /> Cochere which encroaches into the side setback along Kings Point Drive. Although <br /> the Proposed Buildings are setback 25 feet, each Porte Cochere is proposed to be <br /> setback approximately 3'2°. <br /> • Building Separation: Section 265-34(D)(6)(a) states: When there are two or more <br /> towers on the same property, the building separation shall be a minimum of 50 feet <br /> between towers. Here, there is a separation of approximately 33'7° at the <br /> narrowest center point and 43'9° at the corners, between the North Tower and the <br /> Parking Garage,which triggers.the need for a.variance. _- _ <br /> {40589909;2} <br />
