whether performed by Contractor, or persons employed or utilized by Contractor. 28.4 This indemnity will survive the cancellation or expiration of this Agreement. This indemnity will be interpreted under and construed to conform to the laws of the State of Florida. 28.5 Contractor shall require all Sub-Contractor agreements to include a provision that they shall indemnify, defend and hold harmless the City to the extent caused by the negligence, recklessness or intentional wrongful misconduct of the subcontractor and/or persons employed or utilized by subcontractor in the performance of any Work under this Agreement. ARTICLE 29. INSURANCE REQUIREMENTS 29.1 Contractor shall not start Work under this Agreement until it has delivered to the City certificates of insurance clearly indicating that the Contractor is in compliance with the following Insurance Requirements: Comprehensive General Liability with minimum limits of Five Million Dollars ($5,000,000.00) per occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. Coverage must be afforded on a form no more restrictive than the latest edition of the Comprehensive General Liability policy, without restrictive endorsements, as filed by the Insurance Services Office, and must include: o Premises and Operation o Independent Contractors o Products and/or Completed Operations Hazard o Broad Form Property Damage o Broad Form Contractual Coverage applicable to this specific Contract, including any hold harmless and/or indemnification agreement. o Personal Injury Coverage with Employee and Contractual Exclusions removed, with minimum limits of coverage equal to those required for Bodily Injury Liability and Property Damage Liability. At the Contractor's expense, it will provide Builders Risk Insurance(BRI)for the full value of the completed project. The BRI shall be in place, naming the City as additionally insured,prior to mobilization and will remain in effect until final completion of the project. Workers' Compensation in accordance with Florida Statute, including Employers' Liability with separate limits of$1,000,000 for all causes. Business Automobile Liability with minimum limits of Five Million Dollars ($5,000,000.00) per occurrence combined single limit for Bodily Injury Liability and Property Damage Liability.
