o Employers' Non-Ownership. <br /> Before starting the Work, the Contractor will file and make sure that all certificates <br /> of insurance required by this Agreement are in the City's possession. These <br /> certificates shall contain a provision that the coverage afforded under the policies <br /> will not be canceled or materially changed until at least thirty(30)days prior written <br /> notice has been given to the City by certified mail. The City shall be named as an <br /> additional insured on the above-referenced policies. <br /> Contractor agrees that if any part of the Work under is subcontracted, they will <br /> require the Sub-contractor(s) to carry insurance as required, and that they will <br /> require the Sub- contractor(s) to furnish to them insurance certificates similar to <br /> those required by the City in this section. <br /> Cancellation and Re-Insurance: <br /> If any insurance should be canceled or changed by the insurance company or should <br /> any insurance expire during the period of this contract, the Contractor shall be <br /> responsible for securing other acceptable insurance to provide the coverage <br /> specified in this section to maintain coverage during the life of this Agreement. All <br /> deductibles must be declared by the Contractor and must be approved by the <br /> City. At the option of the City, either the Contractor shall eliminate or reduce such <br /> deductible or the Contractor shall procure a Bond, in a form satisfactory to the City, <br /> covering the same. <br /> 29.2 Contractor shall maintain coverage with equal or better rating as required herein for the <br /> term of this Agreement. Contractor shall provide written notice to the City of any material change, <br /> cancellation and/or notice of non-renewal of the insurance at least 30 (thirty) days prior to the <br /> anticipated change or event. Contractor shall furnish a copy of the insurance policy or policies <br /> upon request of the City. <br /> 29.3 Contractor shall furnish copies of insurance policies pertaining to this Agreement to the <br /> City within ten (10) days of written request. If the initial insurance expires prior to the completion <br /> of the Work, renewal copies of policies shall be furnished at least thirty (30) days prior to the date <br /> of their expiration. <br /> 29.4 The City reserves the right to require modifications, increases,or changes in the Insurance <br /> Requirements, and shall provide a thirty (30) day written notice thereof to the Contractor. <br /> • <br /> ARTICLE 30. PAYMENT AND PERFORMANCE BOND <br /> 30.1 Contractor shall not start Work under this Agreement until it has delivered to the City a <br /> Performance Bond and a Payment Bond in accordance with Section 2.7 of RFP No. 14-09- <br /> 01 which is incorporated into this Agreement and requires that the Contractor furnish a <br /> Performance and Payment Bond in the amount of 100% of the total Contract Price with the <br /> City named as the Obligee, as security for the faithful performance of this Agreement and <br /> for the payment of all persons performing labor or furnishing materials in connection with <br /> C6154-1617-037 EBSARY FOUNDATION CO. 19 <br /> U <br />
