o Employers' Non-Ownership. Before starting the Work, the Contractor will file and make sure that all certificates of insurance required by this Agreement are in the City's possession. These certificates shall contain a provision that the coverage afforded under the policies will not be canceled or materially changed until at least thirty(30)days prior written notice has been given to the City by certified mail. The City shall be named as an additional insured on the above-referenced policies. Contractor agrees that if any part of the Work under is subcontracted, they will require the Sub-contractor(s) to carry insurance as required, and that they will require the Sub- contractor(s) to furnish to them insurance certificates similar to those required by the City in this section. Cancellation and Re-Insurance: If any insurance should be canceled or changed by the insurance company or should any insurance expire during the period of this contract, the Contractor shall be responsible for securing other acceptable insurance to provide the coverage specified in this section to maintain coverage during the life of this Agreement. All deductibles must be declared by the Contractor and must be approved by the City. At the option of the City, either the Contractor shall eliminate or reduce such deductible or the Contractor shall procure a Bond, in a form satisfactory to the City, covering the same. 29.2 Contractor shall maintain coverage with equal or better rating as required herein for the term of this Agreement. Contractor shall provide written notice to the City of any material change, cancellation and/or notice of non-renewal of the insurance at least 30 (thirty) days prior to the anticipated change or event. Contractor shall furnish a copy of the insurance policy or policies upon request of the City. 29.3 Contractor shall furnish copies of insurance policies pertaining to this Agreement to the City within ten (10) days of written request. If the initial insurance expires prior to the completion of the Work, renewal copies of policies shall be furnished at least thirty (30) days prior to the date of their expiration. 29.4 The City reserves the right to require modifications, increases,or changes in the Insurance Requirements, and shall provide a thirty (30) day written notice thereof to the Contractor. • ARTICLE 30. PAYMENT AND PERFORMANCE BOND 30.1 Contractor shall not start Work under this Agreement until it has delivered to the City a Performance Bond and a Payment Bond in accordance with Section 2.7 of RFP No. 14-09- 01 which is incorporated into this Agreement and requires that the Contractor furnish a Performance and Payment Bond in the amount of 100% of the total Contract Price with the City named as the Obligee, as security for the faithful performance of this Agreement and for the payment of all persons performing labor or furnishing materials in connection with C6154-1617-037 EBSARY FOUNDATION CO. 19 U
