Summary Minutes:Regular City Commission Meeting July 19,2012 City of Sunny Isles Beach,Florida <br /> Relating to a Sovereignty Submerged Lands Lease for Operation of the Newport <br /> Fishing Pier,in Substantially the Same Form Attached Hereto as Exhibit"A";Authorizing <br /> the Mayor to Execute Said Agreement;Authorizing the City Attorney and the City Manager <br /> to Do All Things Necessary to Effectuate the Terms of this Agreement; Providing for an <br /> Effective Date. <br /> Action:[City Clerk's Note: Item distributed prior to meeting. See additional action under <br /> Item 4A.J City Clerk Hines read the title, and City Attorney Ottinot reported that the State <br /> has agreed to lease the submerged land to the City on a five-year term. Generally the State <br /> requires a lease fee but the State has agreed to waive that fee during construction of the Pier. <br /> Public Speakers: None <br /> Commissioner Aelion asked what the fee would be once the construction is completed,and <br /> Assistant City Manager/Finance Shah said it is a formula based on our net operating revenue. <br /> She explained that at this point it is difficult to calculate not knowing what our revenues or <br /> direct/indirect costs are going to be,however it should be nominal. Mayor Edelcup said it <br /> would be a percentage of any revenues, and he asked if we have any idea what that <br /> percentage number is. City Attorney Ottinot said we can give the Commission a formula that <br /> they have given us in the past, and Mayor Edelcup asked that a memo be distributed to the <br /> Commission. <br /> Vice Mayor Thaler moved and Commissioner Scholl seconded a motion to approve the <br /> resolution. Resolution No. 2012-1951 was adopted by a voice vote of 5-0 in favor. <br /> 11. MOTIONS <br /> None <br /> 12. DISCUSSION ITEMS <br /> None <br /> 13.
