Attachment number 3 Wage 5 of <br />Currently, the boat storage that occurs on the current site is not only unsightly but minimally maintained. <br />The beautiful new marina facility will be an attraction that is completely equipped with the latest safety <br />marina mechanisms and will overall not only not endanger or be detrimental to the public- it will enhance <br />the public health, safety and welfare as well as providing a desirable service to the boating community <br />who long to become residents of Sunny Isles Beach. <br />(3) The proposed use shall be consistent with the community character of the immediate <br />neighborhood of the proposed use; <br />This site has always been used as a marina facility but over the years has become less and less desirable <br />as it became older and less maintained. The new marina will be housed a state -of -the -art brand new <br />building that will match the brand new buildings that have been built along Sunny Isles Boulevard, <br />utilizing this waterway in the best suited way. <br />(4) Utilities, roadway capacity, drainage, and other necessary public facilities, including <br />police, fire and emergency services, shall exist at the City's adopted levels of service, <br />or will be available concurrent with demand as provided for in the requirements of <br />theses LDRs; <br />This conditional use is submitted in tandem with an overall site plan approval that ensures this <br />requirement is met for the project in its entirety including this conditional use. <br />(S) Adequate measures exist or shall be taken to provide ingress and egress to the <br />proposed use in a manner that minimizes traffic congestion in the public streets; <br />The ingress and egress points as well as the stacking and parking have been reviewed by FDOT and <br />sufficient parking has been provided in accordance with the code. Additional a traffic study has been <br />performed and submitted to the City to ensure a minimization of traffic congestion and proper usage of <br />the public streets. <br />(6) The establishment of the conditional use shall not impede the development of <br />surrounding properties for uses permitted in the zoning district; <br />There is nothing inherent in this Project that will impede any development along Sunny Isles Blvd or the <br />TCO South Edge. <br />(7) The design of the proposed use shall minimize adverse effects, including visual <br />impacts, of the proposed use on adjacent property through the use of building <br />orientation, setbacks, buffers, landscaping and other design criteria. <br />The design of the Project has been oriented to provide maximum views to the North, has natural view <br />corridors and minimum adverse affects to adjacent developed properties to the East especially with the <br />WASA site immediately adjacent on the east and the proposed Chabad to be developed on the west side. <br />Applicant has agreed to a beautiful landscape design including for the WASA site as well as along the <br />continuous baywalk along the waterway. This Project and its unique state of the art marina facility will <br />enhance the visual aesthetics of the entire Town Center South Edge District and will be a welcome <br />addition to Sunny Isles Blvd. <br />Graphics on Construction Fence. In accordance with Section265 -63.3 (G) of the City's LDRs, the City <br />Commission, in its discretion, may permit graphics and painted murals on temporary construction fences <br />for aesthetic enhancement of the fence and advertisement of the project to be constructed at site plan <br />Agenda Item No.6A \nDate 9/20/2012 <br />42 <br />
