• Any other municipal facility or site as may be directed by the City Debris Manager. <br />• Private property when necessary to protect the public or to facilitate completion of required work, provided that entry onto <br />private property is specifically authorized by the City Debris Manager. <br /> <br />Collins Avenue (A1A), State Route 826 and State Route 856 are on the Federal Highway System and are considered Federal Aid <br />System (FAS) roads and will not be subject to debris removal and disposal operations unless specifically directed by the City <br />Debris Manager. The City and Contractor will comply with the provisions of the Federal Highway Administration <br />Form FHWA-1273 (Ref. 3-94), with the exception of the Davis Bacon Provisions which are waived for strictly <br />debris removal projects. FHWA Form 1273 has been physically incorporated into this Agreement in SECTION 23 <br /> <br />All debris removal and disposal operations east of Collins Avenue (A1A) are the responsibility of the Hotel / Motel / Condominium <br />owners. <br /> <br />The Contractor may be responsible for sand removal resulting from storm action deposited on Collins Avenue (A1A) and to the <br />West side of Collins Avenue (A1A). Removal and cleaning of the sand will be done only by a written Task Order initiated by the <br />City Debris Manager and paid for in accordance with the Fee Schedule Form Line # 7 Sand Collections and Screening. <br /> <br />The Contractor must be duly licensed to perform the work in accordance with the State of Florida code requirements. The <br />Contractor shall obtain all permits necessary to complete the work. The Contractor shall be responsible for determining what <br />additional permits are necessary to perform under the contract, but at the minimum must hold a business license and Contractor's <br />license where services are performed. Copies of all permits shall be submitted to the City Debris Manager as soon as available. <br /> <br />The quantity of work required to complete this contract is estimated. The actual effort required may be more or less than the <br />estimated amount shown on the Fee Schedule Form. Payment will be made at the unit rates proposed by the Contractor. The <br />output will be verified by the City Debris Manager in the daily operational report. Should hourly rates be used to pay for certain <br />equipment, then preventative maintenance not in excess of fifteen (15) minutes in a normal workday will be paid at the regular <br />hourly rate. Preventative maintenance or down time resulting from equipment failure, routine maintenance and fueling that <br />exceeds fifteen (15) minutes will be considered unacceptable work and non-payment of that time will be rounded off to the half <br />hour of all hours where delays occur. Preventative maintenance is defined as the usual field maintenance to keep equipment in <br />operating condition without the use of extensive shop equipment. Fueling of equipment will be considered as part of preventative <br />maintenance. <br /> <br />The Contractor shall be responsible for correcting any notices of violations issued as a result of the Contractor's or any <br />subcontractor's actions or operations during the performance of this contract. Corrections for any such violations shall be at no <br />additional cost to the City. <br /> <br />The Contractor shall conduct the work so as not to interfere with the disaster response and recovery activities of federal, state <br />or local governments or agencies, or of any public utilities or other private Contractors. <br /> <br /> <br />3.4.2. Post-Hurricane/Disaster Recovery Operations: Debris Clearing and Removal <br /> <br />This Work is divided into two phases. Phase 1 will be performed on a time and materials basis, and Phase 2 is to be performed <br />on a unit price basis. <br />• Phase 1. Emergency Roadway Debris Clearing, consisting of clearing roadway debris to the side of the road to open key <br />access routes into devastated areas. <br />• Phase 2: Public Rights-of-Way Debris Removal, consisting of the removal and transport of eligible disaster-generated debris <br />from designated public streets or highway rights-of-way or public property to an approved landfill. The City will pay tipping <br />fees at the approved landfill based on the actual disposal tickets and accompanying rates for disposal without additional <br />mark-up from the Contractor. <br /> <br />3.4.3. Inspection of Debris <br /> <br />Within 24 hours after the hurricane/disaster event has subsided, the Contractor must make a detailed and thorough on-site <br />inspection with a representative from the City of debris to be cleared and removed, and consider: <br /> <br />• Amounts and types of debris; <br />• Working conditions such as traffic, street/road width, and land use; <br />• Means to ingress and egress work areas; and <br />• All other factors affecting the work. <br /> <br />3.4.4. Coordination <br /> <br />Debris Clearing and Removal is limited to that which is determined by the City Debris Manager to be in the interest of public <br />safety and that which is considered essential to the economic recovery of the affected area. The Contractor must coordinate <br />with other contractors and other public and private entities also performing recovery operations. <br /> <br />3.4.5. City limits <br /> <br />Debris collection is limited to areas within the City of Sunny Isles Beach. <br />4
