<br />City of Sunny Isles Beach <br />NE 174th Street Roadway Improvements <br />00800-6 Special Conditions and <br />Supplementary Conditions <br />14-1758 / 09-19-2014 <br /> <br />11. PROTECTION OF WILDLIFE: <br /> <br />The CONTRACTOR shall take all precautions to ensure the protection of wildlife <br />within the project limits. Of particular interest is the aquatic life existing within the <br />Intracoastal Waterway. The aquatic life is defined as, but not limited to, all species <br />of fish and aquatic vegetation that reside within the canal system. <br /> <br />12. PROTECTION OF THE WEST INDIAN OR FLORIDA MANATEE: <br /> <br />The aquatic mammal known as the “Manatee” is a federally protected endangered <br />species. The “Manatee” has been known to frequent the warm inland waters in and <br />around the vicinity of this project. The CONTRACTOR shall take all necessary <br />precautions to ensure the safety of “Manatees” that may enter the construction <br />area. <br /> <br />a. Manatees are not to be fed or harassed and work within the canal will be <br />halted if a Manatee is sighted within fifty (50) yards of the work area. <br />Work can resume only after the Manatee(s) have cleared the work zone. <br /> <br />b. The CONTRACTOR shall contact the Florida Game & Fish Commission, <br />Bureau of Protected Species Management for the current rules and <br />regulations regarding the treatment and protection of Manatees. The <br />cost of any measures necessary for Manatee protection is understood to <br />be included in various CONTRACT unit prices. <br /> <br /> <br />c. The CONTRACTOR shall not be entitled to any claim for damages or <br />delay resulting from the presence of Manatees within the work zone. <br /> <br /> <br />13. ASBESTOS-CEMENT PIPE REMOVAL <br /> <br /> The CONTRACTOR shall use caution while removing any asbestos-cement pipe <br />(ACP). Pipe shall be disconnected at joints and removed and disposed of <br />without breaking. If the existing pipe is friable or requires cutting, the <br />CONTRACTOR shall remove and dispose of the pipe in accordance with EPA <br />regulations. <br /> <br />14. UTILITY LOCATION <br /> <br /> The CONTRACTOR shall notify each utility company sufficiently ahead of <br />construction to arrange for positive underground locations (Soft Digs), relocation <br />or support of its utility where that utility may be in conflict with or endangered by <br />the proposed construction. Moving any water/sewer mains or utilities solely for <br />the convenience of the CONTRACTOR shall be paid for by the CONTRACTOR. <br />The CONTRACTOR shall pay for all charges by the utility companies for <br />temporary support of its utilities.
