<br />City of Sunny Isles Beach |Request for Proposal No. 17-11-01 25 <br /> <br />o Proposer shall be required to provide all employees with uniforms. Which shall be <br />subject to the prior written approval by the City Manager or designee. <br />o Proposer shall perform drug test screening on all employees and provide pass/fail <br />results to the City Manager or designee, upon request. <br /> <br />Any and all employees and/or other individuals retained by proposer, shall not, for any <br />purposes, be considered to be employees of the City of Sunny Isles Beach, and proposer <br />shall be solely responsible for their supervision and daily direction and control. <br /> <br />3.17 COMPLAINTS AND DISPUTES <br /> <br />All complaints will be forwarded to the contract manager. If the incident requires formal <br />investigation, the proposer will be notified of the complaint by certified mail. The proposer <br />will have seven (7) business days to reply to the complaint in writing. After the investigation <br />is completed, a memo will be forwarded to the Chief of Police regarding the outcome. If <br />the complaint is sustained, a recommendation of disciplinary action against the proposer <br />will be forwarded to the Chief of Police. <br /> <br />The proposer agrees that any complaints received by the City concerning misconduct on <br />the part of the proposer, such as excessive charges, poor business practices, damage to <br />vehicles, etc., that cannot be resolved between the proposer and the Police Chief’s <br />designee, will be referred to the Police Chief's office for appropriate action, including <br />contract termination. If the complaint is not resolved to the satisfaction of the Police Chief <br />or the owner of the vehicle, it may be referred to the City Manager's office. <br /> <br />3.18 PRIVATE COMMERCIAL TOWING COMPANIES <br /> <br /> The City has the right to waive awarding bids from towing companies contracted to <br /> tow for private commercial businesses within the City limits of Sunny Isles Beach due to <br /> conflicts of interest. <br /> <br />3.19 NON-EXCLUSIVE SERVICES <br /> <br /> Nothing contained in this contract will prevent the owner or operator of a motor vehicle <br /> from calling a wrecker or tow truck of their choice, or requesting that their vehicle be towed <br /> to a garage location or compound of his/her choice and not that of the City’s proposer (s) <br /> for Towing Services, unless the disabled vehicle cannot be removed in forty (40) minutes <br /> or less is creating a tie up of traffic or hazardous situation, in the opinion of the officer at <br /> the scene. <br /> <br /> <br />
