• <br /> 40 FIRST:the lessee shall not assign this lease.or sub-let the premises,or any part thereof nor use <br /> the same.or any part thereof,nor permit the same,or any pan thereof. to be used for any <br /> other purpose than as above stipulated. nor make any alterations therein, and all additions <br /> thereto, without the written consent of the lessor. and all additions. fixtures or improvements <br /> which may be made by lessee,except moveable office furniture,shall become the property of <br /> the lessor and remain upon the premises as a pan thereof, and be surrendered with the <br /> premises at the termination of this lease. <br /> SECOND: All personal property placed or moved in the premises above described shall be at <br /> the risk of the lessee or owner thereof,and Lessor shall not be liable for any damage to said <br /> personal property.or to the Lessee arising from the bursting or leaking of alter pipes.or from <br /> any act of negligence of any co-tenant or occupants of the building or of any other person <br /> whomsoever. Lessee shall be responsible,at its expense,for fire and extended coverage <br /> insurance on all of its personal property,including removable trade fixtures.located in the <br /> Leased Premises. Lessee and Landlord shall,each at its own expense.maintain a policy or <br /> policies of comprehensive general liability insurance with respect to the particular activities of <br /> each in the Building with the premiums thereon fully paid on or before due date.Such insurance <br /> policy shall be issued by and binding upon an insurance company approved by Landlord,and <br /> shall afford minimum protection of not less than 5300.000 combined single limit coverage of <br /> bodily injury.property damage or combination thereof.Lessee shall provide Landlord with <br /> current Certificates of insurance evidencing Santi Brothers Construction as a named insured as <br /> evidence of Lessee compliance with this Paragraph. <br /> THIRD: That the Lessee shall promptly execute and comply with all statues, ordinances. <br /> rules, orders. regulations and requirements of the Federal. State and City Government and of <br /> any and all their Departments and Bureaus applicable to said premises. for the correction. <br /> prevention, and abatement of nuisances or other grievances, in, upon. or connected with <br /> said premises during said term:and shall also promptly comply with and execute all rules. <br /> orders and regulations of the applicable fire prevention codes for the prevention of fires,at <br /> 40 own cost and expense. The Tenant shall be responsible for maintaining fire extinguishers as <br /> required by applicable code. The Tenant shall not generate toxic waste. <br /> FOURTH:In the event the premises shall be destroyed or so damaged or injured by fire or other <br /> casualty during the Life of this agreement,whereby the same shall be rendered untenantable, <br /> then the lessor shall have the right to render said premises tenantable by repairs within ninety <br /> days therefrom.If said premises are not rendered tenantable within said time, it shall be <br /> optional with either party hereto to cancel this lease,and in the event of such cancellation the <br /> rent shall be paid only to the date of such fire or casualty.The cancellation herein mentioned <br /> shall be evidenced in writing. <br /> FIFTH:For any payment that is not paid within 10days after its due date.Tenant shall pay a late <br /> fee of$25.00. For any returned check the Tenant shall pay a fcc of 535.00. In the event <br /> of a default made by Tenant in the payment of rent when due to Landlord.Tenant shall have fifteen <br /> t 15)days after receipt of written notice thereof to cure such default.In the event of a default made <br /> by Tenant in any of the other covenants or conditions to be kept,observed and performed by Tenant. <br /> Tenant shall have thirty 130)days after receipt of written notice thereof to cure such default. In the <br /> event that the Tenant shall fail to cure any default within the time allowed under this paragraph. <br /> Landlord may declare the term of this Least ended and terminated by giving Tenant written notice of <br /> such intention,and if possession of the Leased Premises is not surrendered.Landlord may reenter <br /> said premises.Landlord shall have,in addition to the remedy above provided.any other right or <br /> remedy available to Landlord on account of any Tenant default.either in law or equity.Landlord <br /> shall use reasonable efforts to mitigate its damages. <br /> SIXTH:Ifthe lessee shall abandon or vacate said premises before the end of the term of this <br /> lease,or shall suffer the rent to be in arrears,the lessor may.at his option,forthwith cancel this <br /> lease or he may enter said premises as the agent of the lessee.without being liable in any way <br /> therefor.and relet the premises with or without any furniture that may be.therein,as the agent <br /> of the lessor.at such price and upon such terms and for such duration of time as the lessor may <br /> determine.and receive the rent therefor. artplying the same to the payment of the rem due by <br /> ducat presents,and if the trill rental Herein provided shall not be realized by lessor over and <br /> above the expenses to lessor in such re-letting the said lessee shall pay any deficiency.and if rd e- <br /> 2ND r�" 11- 6 1 <br />
