<br />City of Sunny Isles Beach |Request for Qualifications No. 17-12-01 14 <br /> <br />2.14 NONDISCRIMINATION <br /> <br />During the performance of this Contract, Consultant agrees to not discriminate against any <br />employee or applicant for employment because of race, religion, color, sex, handicap, marital <br />status, age or national origin, and will take affirmative action to ensure that they are afforded equal <br />employment opportunities without discrimination. Such action shall be taken with reference to, <br />but not be limited to, recruitment, employment, termination, rates of pay or other forms of <br />compensation, and selection for training or retraining, including apprenticeship and on -the-job <br />training. By entering into this Contract with the City, the Consultant attests that it is not in violation <br />of the Americans with Disabilities Act of 1990 (and related Acts). If the Consultant or any <br />owner, subsidiary or other firm affiliated wit h or related to the Consultant is found by the <br />responsible enforcement agency or the City to be in violation of the Act, such violation shall render <br />this Contract void. This Contract shall be void if the Consultant submits a false affidavit or the <br />Consultant violates the Act during the term of this Contract, even if the Consultant was not in <br />violation at the time it submitted its affidavit. <br /> <br />2.15 MINORITY/WOMEN (M/WBE PARTICIPATION) <br /> <br /> If you firm is certified minority business enterprise as defined by the Florida Small and Minority <br /> Business Assistance Act of 1985, include your certification with your RFQ response. <br /> <br />C.F.R. 200.321 encourages the active participation of minority businesses, women’s business <br />enterprises and labor surplus area firms as a part of any subsequent agreement whenever possible. <br />If subcontracts are to be permitted, through a prime Consultant, that Consultant is required to take <br />the affirmative steps listed in items (1) through (5) below. <br /> <br />(1) Placing qualified small and minority businesses and women's business enterprises on <br />solicitation lists; <br />(2) Assuring that small and minority businesses, and women's business enterprises are <br />solicited whenever they are potential sources; <br />(3) Dividing total requirements, when economically feasible, into smaller tasks or quantities <br />to permit maximum participation by small and minority businesses, and women's business <br />enterprises; <br />(4) Establishing delivery schedules, where the requirement permits, which encourage <br />participation by small and minority businesses, and women's business enterprises; <br /> (5) Using the services and assistance, as appropriate, of such organizations as the Small <br /> Business Administration and the Minority Business Development Agency of the <br /> Department of Commerce. <br /> <br />2.16 COMPLIANCE WITH LOBBYIST LAWS <br />
