services in connection with the "Regional Hybrid Skatepark/Pumptrack Initiative at Haulover <br />Park" as described in the Contract Documents. <br />ARTICLE 2. SCOPE OF WORK <br />2.1 Contractor shall provide all labor, materials, equipment, tools, manpower, <br />management, supervision, and all other necessary goods and services to perform the following <br />described Work in Attachment "A", attached hereto and made a part hereof, pursuant to the terms <br />and conditions set forth by the NJPA RFP No. 030117 and Contract No. 030117-ARC, which <br />documents are incorporated herein by reference. This Scope of Work is for the "Regional Hybrid <br />Skatepark/PumptrackInitiative at Haulover Park" as described in the Contract Documents. <br />2.2 Condition of the construction site within the Skatepark. The area to be developed by <br />the Contractor as the Skatepark is depicted in the diagram on Attachment "B" and shall be referred <br />to herein as the "Construction Site." The Construction Site shall be used by Contractor for staging <br />and construction of the Skatepark in accordance with the terms and conditions of this Agreement. <br />Neither Miami -Dade County nor the City make any representations or warranties to Contractor as <br />to the site or environmental conditions of the Construction Site nor of its suitability for <br />development of the Skatepark. Contractor acknowledges and accepts the Construction Site "as is" <br />and understands and agrees that it shall be solely responsible for all site conditions encountered at <br />the Construction Site during development of the Skatepark and shall be responsible for addressing <br />same during construction. <br />2.3 The Contractor will, in consideration for the Contract Amount, design, permit and build all <br />the Skatepark improvements on the Construction Site to the standards, latest applicable building <br />codes and regulations, and, in accordance with the County approved Final Plans. <br />ARTICLE 3. COMMENCEMENT AND COMPLETION OF WORK <br />3.1 Contractor shall commence the construction portion of Work promptly upon receiving a <br />Notice to Proceed from the City, which notice shall be given only upon the City's approval of the <br />Plans and Specifications. The Contractor will obtain any required permits and licenses prior to <br />commencement of construction. Contractor will, from and after the date on which construction <br />commences, diligently and continuously perform and prosecute the Work to its completion in <br />accordance with the Contract Documents, and shall use their best efforts to achieve Final <br />Completion of the entire Project within One Hundred Eighty Days (180) calendar days after <br />Contractor's receipt of the City's Notice to Proceed (such date of required completion being <br />referred to herein as the "Final Completion"). <br />3.2 Notwithstanding any provision contained herein which could be construed to the contrary, <br />Final Completion (herein so called) of the Project shall not be deemed to have occurred until and <br />unless (a) construction thereof is sufficiently complete so that the Project may be used by the City <br />and Miami -Dade County for its intended purpose, subject only to minor "punch list" -type items, <br />(b) all required permits, licenses, certificates of compliance, certificates of occupancy and other <br />approvals from the applicable governmental authorities exercising jurisdiction over the Project <br />shall have been issued, (c) all utilities necessary to service the Project, if included as part of <br />Contractor's Work, have been connected and are available for immediate use and (d) the City shall <br />030.6178 - AMERICAN RAMP COMPANY <br />
