<br />City of Sunny Isles Beach | Invitation to Bid No. North Bay Road Drainage Improvements 18-04-01 14 <br /> <br />for the employment, conduct and control of its employees and for any injury sustained by <br />such employees in the course of their employment <br /> <br />2.12.4 Environmental Pollution Insurance <br /> <br /> The Contractor shall carry an Environmental Pollution Insurance for pollution-related <br /> incidents, including the cost of cleaning up a site after a pollution incident, with limits not <br /> less than $500,000.00 Dollars per occurrence with deductible not greater than <br /> $100,000.00. An additional Form or endorsement to the Commercial General Liability <br /> Insurance to include an Environmental Pollution Insurance coverage providing the <br /> specified coverage, is acceptable. <br /> <br /> 2.12.5 Cancellation and Re-Insurance <br />If any insurance should be cancelled or changed by the insurance company or should any <br />insurance expire during the period of this contract, the Consultant shall be responsible for <br />securing other acceptable insurance to provide the coverage specified in thi s section to <br />maintain coverage during the life of this Contract. All deductibles must be declared by the <br />Bidder and must be approved by the City. At the option of the City, either the Bidder shall <br />eliminate or reduce such deductible or the Bidder shall procure a Bond, in a form <br />satisfactory to the City, covering the same. <br /> <br /> NOTE: THE CITY OF SUNNY ISLES BEACH, CONTRACT NUMBER AND TITLE MUST <br /> APPEAR ON EACH CERTIFICATE OF INSURANCE. THE CITY OF SUNNY ISLES BEACH <br /> MUST BE SHOWN AS AN ADDITIONAL INSURED WITH RESPECT TO THIS COVERAGE. <br /> <br />2.13 EXAMINATION OF SITE <br /> <br />Each Bidder shall visit the site of the proposed work before submitting Bid and shall fully acquaint <br />themselves with conditions relating to construction and labor so that he or she may fully understand <br />the facilities, difficulties and restrictions attending the execution of work under the Contract. It will <br />be assumed that the Bidder has investigated and is satisfied as to the conditions of work to be <br />performed and materials to be furnished and shall base Bid on their own opinion of the conditions <br />likely to be encountered, and for the bid price must assume all risk of variance, by whomsoever <br />made in any computation or statement of amounts or quantities necessary to fully complete the <br />work in strict compliance with the Contract Documents. <br /> <br />Each Bidder shall thoroughly examine and be familiar with the plans and specifications. The failure <br />or omission of any Bidder to receive or examine any form, instrument, addendum or other <br />documents, or to visit the site and acquaint themselves with conditi ons there existing, shall in no <br />way relieve any Bidder from any obligation with respect to their Bid or to the Contract. The <br />submission of a Bid shall be taken as prima facie evidence of compliance with this document. <br /> <br />No plea of ignorance of conditions that exist or that may hereafter exist, or of conditions or <br />difficulties that may be encountered in the execution of the work under this Contract, as a result <br />of failure to make the necessary examinations and investigations, will be accepted as an excuse <br />for any failure or omission on the part of the Contract to fulfill, in every detail, all of the <br />requirements of Contract Documents, nor will they be accepted as a basis on any claim whatsoever <br />for extra compensation or for any extension of time.
