<br />City of Sunny Isles Beach | Invitation to Bid No. North Bay Road Drainage Improvements 18-04-01 15 <br /> <br />2.14 DISCREPANCIES <br /> <br /> Should a Bidder find discrepancies or ambiguities in, or omissions from, the Drawings or <br /> Specifications, or should they be in doubt as to their meaning, they shall at once notify the <br /> City in writing. <br /> <br />2.15 INTERPRETATION OF PLANS AND DRAWINGS <br /> <br /> On all drawings, the figured dimension shall govern in case of discrepancy between the scales and <br /> figures. The Contractor shall take no advantage of any error or omission in the Drawings or of any <br /> discrepancy between the Drawings and Specifications. The Engineer of Record shall make <br /> such interpretations as may be deemed necessary for the fulfillment of the intent of the Drawings <br /> and Specifications as construed by the Engineer, and his/her decision shall be final. If there is a <br /> discrepancy between plans and specifications, the specifications govern. <br /> <br />2.16 LABOR REGULATIONS <br /> <br /> The Contractor shall fully comply with all laws and regulations concerning labor, work <br /> hours, wage rates, labor conditions and related matters. No contractor or subcontractor contracting <br /> for any part of the contract work which may require or involve the employment of laborers or <br /> mechanics shall require or permit any such laborer or mechanic in any workweek in which he or <br /> she is employed on such work to work in excess of forty hours in such workweek unless such <br /> laborer or mechanic receives compensation at a rate not less than one and one -half times the basic <br /> rate of pay for all hours worked in excess of forty hours in such workweek. <br /> <br />2.17 LICENSES, PERMITS AND FEES <br />The Contractor shall obtain and pay for all licenses, permits and inspec tion fees required for this <br />project; and shall comply with all laws, ordinances, regulations and building code requirements <br />applicable to the work contemplated herein. Damages, penalties and or fines imposed on the City <br />or the Contractor for failure to obtain required licenses, permits or fines shall be borne by the <br />Contractor. Contractor shall be required to furnish a certified copy of all licenses, certificates of <br />competency or other licensure requirements necessary to practice his profession as require d by <br />Florida Statutes, Florida Building Code, Miami-Dade County, or City of Sunny Isles Beach Code. <br />These documents shall be furnished to the City along with the Bid response. Failure to furnish <br />these documents or to have required licensure will be grounds for rejecting the Bid as non- <br />responsive or otherwise. <br /> <br />2.18 QUALIFICATION OF BIDDER <br /> <br /> A Bidder will be required to show, to the complete satisfaction of the Owner, that they have <br /> the necessary facilities, equipment, ability, and financial resources to perform the work in a <br /> satisfactory manner, within the time specified. No Contract will be awarded except to responsible <br /> Contractors and businesses capable of performing the class of work contemplated. The Contractor <br /> must be in business for at least 10 years, and completed 5 projects of a similar nature and a <br /> minimum contract value of five hundred thousand ($500,000) dollars or larger. <br />
