The landscape architect will review each easement to offer guidance and suggestions regarding specific <br />locations and siting and to develop a landscape plan to mitigate the impacts of the proposed facility. <br />2. The electrical engineer will coordinate with the utility companies regarding the specific location so that <br />the utility needs are met, and the most desirable location for the easement is selected. <br />3. The City’s public outreach team will approach the property owner to explain the need for the <br />easement, the benefits of the project, and the documents that are needed from the property owner. <br />4. The easement document will be prepared by the surveyor and reviewed by the City’s attorney. We do <br />not propose that the attorney will be the primary point of contact with the property owners as that <br />may raise concerns and motivate property owners to seek their own legal counsel which may result in <br />delays. Additionally, the attorney may need to be available to participate in discussions as needed. <br />5. The surveyor will prepare the associated sketch and legal description. If requested by the homeowner, <br />the surveyor will also stake out the easement and the proposed facilities so that the homeowner can <br />see the proposed improvements. <br />6. Title searches and legal descriptions for the easements will be required from the City’s Attorney. The <br />title search will specify the owner(s) of the property so that the City would be sure that the correct <br />individual(s) sign the easement document. Also, partial releases would need to be obtained from any <br />mortgagee or other lienholder. <br />7. The City’s public outreach team will continue to work with the homeowner to secure his/her signature <br />on the easement documents. This may require several meetings, exchanging documents, providing <br />photos or renderings, etc. We propose to take a cardboard model of a utility cabinet to the site to <br />show reluctant homeowners what the proposed utility cabinet will look like. <br />It is our experience that the vast majority of easements are donated by the property owners. In the event <br />an owner(s) is unwilling to donate the easement property, the City would need to revise the design or <br />commence the eminent domain process. Clearly this is undesirable and frankly we feel it is unexpected. <br />This would again require title searches and a survey legal description of the property. Also, an appraisal <br />would be required for each easement parcel. Once appraisals are obtained, as part of the eminent domain <br />process, the City would be required to make a formal offer to the owner(s) of each easement parcel, enter <br />into a 30-day negotiation period and, if negotiations fail, could then file eminent domain proceedings. Our <br />team is experienced in the eminent domain process in the event that is needed and can recommend local <br />attorneys with experience condemning land for government agencies. <br />Final Design and Contract Documents <br />The project team will finalize the design and create a comprehensive set of construction plans and <br />technical specifications. The final construction plans will include the following: <br />• Cover sheet <br />• General notes <br />• Legend <br />• Key map <br />• Conduit schematic (with number, size, material, utility owner data) <br />• Conduit plan (with specific location of the proposed bank of conduits, limits of pavement restoration, <br />other existing utilities, other existing surface features) <br />• Blow-up details for specific areas with complex conflicts or above ground improvements, etc. <br />• Wiring plan (if the wiring from the new facilities to the meter base is not provided by the utility <br />companies, our team will design and detail those improvements)
