Reserved. <br /> A. Evaluation. <br /> (1) In evaluating an application for a franchise, the City shall consider among other things the <br /> following factors: <br /> (a)The economic impact upon private property within the franchise area; <br /> (c)The capacity of public rights of way to accommodate the cable system; <br /> (e)The potential disruption to existing users of the public rights of way to be used by the cable system <br /> and the resulting inconvenience which may occur to the public; <br /> (f)The legal, technical and financial ability of the franchise applicant to perform; <br /> . . - --- - - - <br /> (h) Such other additional matters, both procedural and substantive, as the City may in its sole <br /> discretion determine to be rele\ant, including but not limited to the extent to which the proposal of <br /> the public interest. <br /> (2) Evaluation by the City shall not be based on the content of the programming the applicant <br /> proposed to provide. <br /> B. The City may grant a franchise for a period not to exceed 15 years. <br /> be set forth in the franchise agreement specifying that failure to comply with the conditions will cause <br /> the franchise to become null and void without further action by the City. <br /> D. Following at least 10 days' notice to the applicant, the City shall hold a public hearing to consider <br /> an application or applications. Based upon the application(s),the testimony presented at the public haring, <br /> application(s), the City shall decide by resolution whether to grant or deny a franchise application(s) <br /> and decide the terms and conditions of any franchise(s)granted. <br /> by any and all bonds,certificates of insurance or other obligations as required in a franchise agreement <br /> within 15 calendar days from the date of the City resolution approving the franchise agreement. This <br /> franchise grant will be null and void without further action by the City. The City may, at its option, <br /> on franchisee the right to an automatic acceptance, transfer, modification or renewal. <br />
