F. The grant, renewal, modification, or transfer of a franchise may be subject to a processing fee in <br /> an amount not to exceed the reasonable and justifiable out of pocket costs incurred by the City in <br /> fees, less the amount of the filing fee set pursuant to § 113 9 up to an amount not to exceed $50,000. <br /> Within 30 calendar days from the date of the resolution approving or denying the franchise agreement <br /> by the City Commission, the City shall notify the franchisee of the amount of any processing fee and <br /> its method of calculation. If the processing fee is not paid to the City within 60 calendar days of the <br /> date of the City Commission resolution approving or denying the franchise agreement, any approval <br /> granted by such resolution will be nuii and void. This processing fee is therefore intended to be a <br /> charge incidental to the awarding or enforcing of a franchise within the meaning of Section <br /> .-- - • . D - <br /> fee imposed in a franchise agreement and shall not be passed through to subscribers. <br /> § 113-11. - Insurance; surety; indemnification. Reserved. <br /> A. A franchisee shall maintain, and by its acceptance of the franchise, specifically agrees that it will <br /> maintain, throughout the entire term of the franchise, including any renewals thereof, the followin <br /> workers' compensation and employer liability insurance to meet all requirements of state law and <br /> general comprehensive liability insurance with respect to the construction,operation and maintenance <br /> (1) $500,000 for property damage in any one accident; <br /> (2) $500,000 for personal bodily injury to any one person; and <br /> (3) $1,000,000 for personal bodily injury in any one accident. <br /> E. • - - - - - - - <br /> sureties with a minimum rating of A 1 in Best's Key Rating Guide, Property/Casualty Edition. The <br /> City may require coverage and amounts in excess of the above minimum where necessary to reflect <br /> changing liability exposure and limits or where required by law. <br /> C. A franchisee shall keep on file with the City certificates of insurance which certificates shall <br /> indicate evidence of payment of the required premiums and shall indicate that the City, its <br /> Commissioners, officers, boards, commission, commissioners, agents and employees are listed as <br /> D. All insurance policies shall name the City as additional insured and shall further provide that any <br /> has been given to the City. A franchisee shall not cancel any required insurance policy without <br /> submission of proof that the franchisee has obtained alternative insurance satisfactory to the City <br /> which complies with this chapter. <br /> officials, boards, commissions, commissioners, agents and employees, against any and all claims, <br /> suits,causes of action,proceedings,judgments for damages or equitable relief,and costs and expenses <br /> arising out of the construction, maintenance or operation of its cable system, the conduct of <br /> franchisee's business in the City, regardless of whether the act or omission complained of is <br /> authorized, allowed or prohibited by this chapter or a franchise agreement; provided, however, that <br /> gross negligence of the City, its officials,beardsTeox i •. . . , .vents,or employees. <br />
