City of Sunny Isles Beach |Request for Proposals No. 18‐11‐02 11   <br />  <br /> <br />The City reserves the right to negotiate lower pricing for the additional term(s) based on market <br />research information or other factors that influence price. The City reserves the right to apply <br />any reduction in pricing for the additional term(s) based on the downward movement of the <br />applicable index. <br /> <br />The City reserves the right to reject any price adjustments submitted by the vendor and/or to not <br />exercise any otherwise available option period based on such price adjustments. Continuation of <br />the contract beyond the initial period, and any option subsequently exercised, is a City <br />prerogative, and not a right of the vendor. This prerogative will be exercised only when such <br />continuation is clearly in the best interest of the City. <br /> <br />Should the vendor decline the City’s right to exercise the option period, the City may consider the <br />vendor in default which may affect the vendor’s eligibility for future contracts. <br /> <br />2.5 METHOD OF AWARD <br /> <br />Award may be by Group or Item, whichever is determined to be in the best interest of the City. If <br />a vendor fails to submit an offer for all items within the group, its offer for that specific group will <br />be rejected. The City reserves the right to award to multiple bidders. Award to multiple vendors <br />may be considered for the convenience of the City and does not exempt the primary vendor from <br />fulfilling its contractual obligations. Failure to perform as noted may result in the vendor being <br />deemed in breach of contract. <br /> <br />2.6 PRICE <br /> <br />The base and alternate unit prices stated in the proposal include all costs and expenses for <br />general conditions, taxes, labor, equipment, materials, commissions, transportation charges and <br />expenses, and labor for handling materials during inspection, together with any and all other <br />costs and expenses for performing and completing the Work as shown on the plans and specified <br />herein. The Basis of Payment for an item at the price shown in the Proposal shall be in <br />accordance with its description of the item in this Section and as related to the Work specified <br />and as shown on the Drawings. The unit prices stated in the Contract shall be considered fixed <br />and firm during the contract term. <br /> <br />2.7 PERFORMANCE AND PAYMENT BOND <br /> <br />The City of Sunny Isles Beach shall require the successful Bidder to furnish a Performance Bond <br />and Payment Bond in the amount of 100% of the total Bid Price, with the City of Sunny Isles <br />Beach as the Obligee, as security for the faithful performance of the Contract and for the <br />payment of all persons performing labor or furnishing materials in connection herewith within ten <br />(10) calendar days after issuance of the Notice of Award by the City. The Performance and <br />Payment Bond shall continue in effect through the contract term. The bonds shall be with a <br />surety company authorized to do business in the State of Florida and having been in business <br />with a record of successful continuous operation for at least five (5) years. <br />
