cc) The City Manager may cause an immediate stop work order where any permitted or <br /> unpermitted construction or other work in the public rights-of-way poses a serious <br /> threat to the health, safety or welfare of the public until such serious threat has been <br /> abated. Failure to comply with such order may subject a registrant, and its agents. <br /> employees, and contractors as applicable, to appropriate enforcement remedies as set <br /> forth in this Ordinance and applicable law. <br /> Sec. 129-67. —Placement or maintenance of a communications facility in public rights of way. <br /> Permit Application Requirements and Review Procedures. <br /> and federal law and City ordinances, codes and regulations in placing or maintaining a <br /> communications facility in public rights of way, including but not limited to Article II, <br /> Telecommunications Rights of Way, of this chapter. <br /> Pre-application meeting. To minimize issues related to a permit application, prior to <br /> applying for a permit. a registrant shall conduct a pre-submittal meeting with the City to <br /> discuss the registrant's plans and network goals for placing or maintaining facilities in the <br /> public rights-of-way unless prohibited by applicable law based on the proposed facilities. <br /> The City shall undertake efforts to accommodate a registrant's request for a pre-submittal <br /> meeting within ten (10) business days of a request. At a registrant's request, the City. in its <br /> sole discretion. may waive the requirement of a pre-submittal meeting for good cause based <br /> on the scope of the proposed permit and registrant's compliance with this Ordinance. In no <br /> event shall a pre-submittal meeting be waived for a consolidated permit to the extent not <br /> inconsistent with applicable law. <br /> Laj Application requirements for all communications facilities in the public rights-of- <br /> way. As part of any permit application to place or maintain any facility pursuant to <br /> this Ordinance in the public rights-of-way. a registrant or a registrant's agent or <br /> contractor shall provide four originals of a permit application in the designated <br /> format with the City that sets forth information required on the City's application <br /> form. including. at a minimum. the following: <br /> (1) If the applicant for the permit is not the registrant, a statement of authority by <br /> the registrant for the applicant to act on behalf of the registrant. In addition. <br /> if the applicant is a contractor. the contractor's license or registration and <br /> insurance information confirming authority to perform construction in the <br /> City and whether the contractor has any open permits with the City. and if so. <br /> the permit identification number or information. <br /> (2) Confirmation that the applicant engaged in a pre-submission meeting or such <br /> meeting was waived by the City or otherwise not required and that the <br /> applicant has an effective registration . <br /> (3) Engineering plan.
