City of Sunny Isles Beach |Request for Qualifications No. 19‐02‐02 14 <br /> <br />2.10 BACKGROUND CHECKS <br /> <br />The successful Respondent will be responsible for hiring the necessary personnel to conduct the <br />specified services and will comply with all federal, state, and local laws related to minimum wage, <br />social security, nondiscrimination, Americans with Disabilities Act (“ADA”), unemployment <br />compensation, and workers’ compensation. The contractor shall be responsible at their sole <br />cost and expense, for ensuring that all staff assigned to this contract shall be required, to pass a <br />criminal background check prior to award of the contract. The criminal background check shall <br />consist of a Florida Department of Law Enforcement (“FDLE”) Florida Crime Information <br />Center/National Crime Information Center (“FCIC/NCIC”) criminal records check. Any employee not <br />meeting this requirement will not be permitted to work at any City facility. <br /> <br />2.11 SUB-CONTRACTORS <br /> <br />If the Respondent proposes to use sub-contractors in the course of providing these services to <br />the City, this information shall be a part of the RFQ response, questionnaire form. Such information <br />shall be subject to review, acceptance and approval of the City, prior to any contract award. The <br />City reserves the right to approve or disapprove of any subcontractor candidate in its best interest <br />and to require Contractor to replace subcontractor with one that meets City approval. <br /> <br />Respondent shall ensure that all of Contractor’s subcontractors perform in accordance with the <br />terms and conditions of this Contract. Contractor shall be fully responsible for all of Contractor’s <br />subcontractors’ performance, and shall be liable for any of Contractor’s subcontractors’ non- <br />performance and all of Contractor’s subcontractors’ acts and omissions. Contractor shall defend, at <br />Contractor’s expense, counsel being subject to the City’s approval or disapproval, and indemnify <br />and hold harmless the City and the City’s officers, employees, and agents from and against any <br />claim, lawsuit, third-party action, or judgment, including any award of attorney fees and any award <br />of costs, by or in favor of any Contractor’s subcontractors for payment for work performed for the <br />City. <br /> <br /> A copy of the proposers’ and Subcontractors' Licenses shall be enclosed with each proposal. <br /> <br />2.12 METHOD OF AWARD – SPOT MARKET QUOTES <br /> <br />Respondents who meet the pre-qualification requirements as listed in Section 3, Group Pre- <br />qualification Criteria, and based on the evaluation of information provided under Section 4, “Bid <br />Submittal Form”, will be deemed pre-qualified to participate in future spot market quotation <br />submittals. For quoting purposes, the City intends to provide the vendors the specifications of the <br />staging requirements at a minimum of 21 days prior to the event. In some instances, the <br />specifications may not be available until less than 21 days to the event, however the Request for <br />Quotes will be issued to the vendors as soon as it’s available. Once quotes have been submitted <br />the City will not only select for award the lowest quote, but will also take into consideration past <br />performance, reputability with the City, the quality assessment of the equipment proposed, and <br />other similar factors that the City deems to be in its best interest. The vendor’s quote shall include <br />all labor including set-up and tear down, equipment, materials, transportation, accommodations
