City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 phone (305) 949-3113 Fax <br />7.16.10 After first giving at least seventy-two (72) hours written notice to the City <br />and the City's Representative, the Contractor shall conduct any and all testing required <br />under the Contract Documents and report the results of same to the City and the City's <br />Representative within twenty-four (24) hours of receipt unless the City or the City's <br />Representative instructs otherwise. The Contractor shall also cooperate with the City and <br />the City's Representative in the event the City or the City's Representative elects to <br />conduct testing for any purpose. The Contractor shall make the site, or any relevant <br />portion thereof, available for such testing by the City or the City's Representative and the <br />Contractor shall so schedule and coordinate its work so as not to interfere with any <br />testing by the City or the City's Representative. When requested by the City or the <br />City's Representative the Contractor shall furthermore uncover Work and otherwise <br />assist in testing as may be required by the City or the City's Representative. The <br />services requested by the City which are required to be provided by an Independent <br />Testing Laboratory shall be paid by the City unless otherwise stated in the Contract <br />Documents. Contractor may not rely upon any testing performed by the City or the City's <br />Representative but shall remain solely responsible for insuring compliance with all <br />Contract Documents and testing requirements. The Contractor shall be responsible for <br />the payment of any of its testing. <br />ARTICLE VIII <br />CONTRACT ADMINISTRATION <br />8.1 City's Consultant En ig neer <br />8.1.1 The City's Consultant Engineer for this project is Calvin Giordano & <br />Associates. In the event the City should find it necessary or convenient to replace the <br />Consultant Engineer the City shall retain a replacement Consultant Engineer and the status <br />of the replacement Engineer shall be that of the former Engineer. <br />8.2 City's Representative <br />8.2.1 The City's Representative, unless otherwise directed by the City in writing, <br />will perform those duties and discharge those responsibilities allocated to the Engineer as <br />set forth in the Contract Documents and this Contract. The City's Representative shall be <br />the City's representative from the effective date of this Contract until final payment has <br />been made. The City's Representative shall be authorized to act on behalf of the City only <br />to the extent provided in this Contract. <br />8.2.2 The Contractor and the City's Consultant Engineer shall communicate with <br />each other in the first instance through the City's Representative. The City's designated <br />representative for the receipt of any such communications, or copies of same, is Richard <br />Labinsky, City of Sunny Isles Beach, 18070 Collins Ave, Sunny Isles Beach, FL 33160, <br />phone number 305-792-1817, and email rlabinsky@sibfl.net. The City reserves the right <br />to change its designated representative upon written notice to the Contractor and City's <br />Representative. <br />20 <br />
