effect in the purchaser’s service garage at the time the defect correction is made. The <br />purchaser shall not accept parts credit as payment of warranty labor claims. <br />4.3 Parts and Labor Reimbursement <br />For reimbursement of parts and labor Contractor shall provide on-line or paper systems <br />including necessary forms to carry out the provisions of all in-house warranty. <br />5.0 VOIDING OF WARRANTY <br />The warranty shall not apply to any part or component of the vehicle that has been <br />subject to misuse, negligence, accident or that has been altered in any way without <br />Contractor approval that adversely affects its performance, safety and reliability. The <br />warranty shall also be void if the purchaser fails to conduct normal inspections and <br />scheduled preventive maintenance procedures as recommended in Contractor’s <br />maintenance manuals. <br />6.0 EXCEPTIONS TO WARRANTY <br />The warranty shall not apply to scheduled maintenance items and normal wear items <br />such as tires and brake pads. Items furnished by the purchaser such as radios, fare <br />boxes and other auxiliary equipment are not covered under this contract warranty <br />unless such equipment is damaged by the failure of a warrantied part or component. <br />7.0 FLEET DEFECTS <br />A fleet defect is defined as the cumulative failure of the same components in the same <br />or similar application where such items are covered by warranty. <br />8.0 SCOPE OF FLEET DEFECT WARRANTY PROVISIONS <br />Contractor shall correct a fleet defect under the warranty provisions defined in Section <br />5.2.0. When the corrective action is identified the Contractor shall also promptly <br />undertake and complete a work program to prevent the occurrence of the same defect <br />in all additional vehicles purchased under this contract. The warranty on items <br />determined to be fleet defects shall be extended for the time and/or miles of the original <br />warranty. For each vehicle involved in a fleet defect, the extended warranty shall begin <br />on the date that the defect was corrected. <br />9.0 EXCEPTIONS TO FLEET DEFECTS PROVISIONS <br />Fleet defect warranty provisions shall not apply to damage that is a result of normal <br />wear and tear to such items as seats, floor covering, windows, interior trim, paint and <br />noncompliance with recommended maintenance practices. The provisions shall not <br />apply to purchaser supplied items such as fareboxes, two-way radios, etc. <br />10.0 CONTRACTORS RESPONSIBILITY <br />Contractors are responsible for all aspects of the warranty process.
