Within fourteen (14) days thereafter, notice of the <br /> amount of the claim with all supporting data shall cover all amounts (direct, indirect and <br /> consequential) to which the claimant is entitled as a result of the occurrence of said event. All <br /> claims for adjustment in the Contract Price or Contract Time shall be determined by the City. <br /> <br /> The value of any Work covered by a Change Order or of any claim for an increase or <br /> decrease in the Contract Price or Contract Time shall be determined by: 1) mutual <br /> acceptance of a lump sum (which may include an allowance for overhead and profit) or 2) by <br /> application of unit prices contained in the Contract Documents to the quantities of the items <br /> involved. The City shall decide, in its sole discretion, whether to issue and agree to a Change <br /> Order, and verbal representations or instructions may not be relied upon by the Contractor. <br /> <br />2.20 DISCREPANCIES <br /> <br />Should a Bidder find discrepancies or ambiguities in, or omissions from, the Drawings or <br />Specifications, or should they be in doubt as to their meaning, they shall at once notify the City in <br />writing. <br /> <br />2.21 DAMAGE TO PUBLIC OR PRIVATE PROPERTY <br /> <br />If property (public or private) is damaged while Contractor is performing work specified or is <br />removed for the convenience of the work, it shall be repaired or replaced at the expense of the <br />contractor in a manner acceptable to the City prior to the final acceptance of the work. Contractor <br />will be responsible for applying and securing any permits that may be required to complete such <br />repairs. Such property shall include but not be limited to: existing facilities and all of its <br />components, site amenities, concrete and/or asphalt surfaces, vehicles, structures, sidewalks, <br />curbs and gutters, driveways, utilities, etc. Contractor must provide protection necessary to <br />prevent damage to property being repaired or replaced. If the work site has any pre-existing <br />damage, the Contractor shall notify the Public Works/Capital Projects Department in writing. <br />Failure to do so shall obligate the contractor to make repairs per the above section. <br /> <br />2.22 UTILITY <br /> <br />It shall be the responsibility of the Contractor to contact all affected utility owners and determine <br />the precise locations of all utilities prior to beginning construction. Utility owners shall be <br />contacted a minimum of 72 hours prior to the commencement of operations. Special care shall <br />be used in working around or near existing utilities, protecting them when necessary to provide <br />uninterrupted service. In the event that any utility service is interrupted, the Contractor shall <br />notify the utility owner immediately and shall cooperate with the owner, or his representative, in <br />the restoration of service in the shortest time possible. Existing fire hydrants shall be kept <br />accessible to fire departments at all times. <br /> <br /> <br />
