EpdvTjho!Fowfmpqf!JE;!2193E418.88DB.5943.:22G.914D7G:28845EpdvTjho!Fowfmpqf!JE;!ED64EEGG.2G1:.5:C6.C4CB.73549671:658 <br />subcontractors or employees, in the performance of services under this Agreement, any <br />sums due CONTRACTOR under this Agreement, as shall be considered necessary by the <br />indemnification pursuant to the above subsections have been settled or otherwise resolved. <br />SHERIFF shall not be liable to CONTRACTOR for damages of any sort, including without <br />limitation, incidental or consequential damages or interest, for the wrongful retention of <br />sums due CONTRACTOR, so long as the decision of the Contract Administrator to retain <br />such funds was made in good faith. <br /> <br />ARTICLE 8 INSURANCE <br /> <br />8.1!Throughout the term of this Agreement and for all applicable statutes of limitations periods, <br />CONTRACTOR shall maintain in full force and effect the insurance coverages set forth in <br />this Article. PLEASE NOTE: Additional Insurance Requirements may be required by <br />the Agreement and project quotation. The provisions of this Article shall survive the <br />expiration or termination of this Agreement <br /> <br />8.2!All insurance policies shall be issued by companies that (a) are authorized to transact <br />business in the State of Florida, (b) have agents upon whom service of process may be <br />-VI or better. <br /> <br />8.3!All insurance policies shall name the following as additional insureds: the Broward <br />Broward County and their officers, employees, agents and commission members with a <br />CG026 Additional Insured Designated Person or Organization endorsement, or similar <br />endorsement to the liability policies. <br /> <br />8.4! <br />primary to any other insurance available to the additional insureds with respect to claims <br />insured against whom claims are made or suit is brought and that the inclusion of more <br />. Self- Insurance <br />shall not be acceptable for this project. <br /> <br />8.5! <br />Contracts Manager with a copy of the Certificate of Insurance or endorsements evidencing <br />the types of insurance and coverages required by this Article within three (3) calendar days <br />of of a notice of intent to award, and, at any time thereafter, upon <br />request by the Sheriff. If the CONTRACTOR fails to submit the required insurance <br />certificate in the manner prescribed with the executed Agreement submitted to BSO and if <br />not submitted with the executed Agreement in no event to exceed three (3) calendar days <br />after request to submit certificate of insurance, the CONTRACTOR shall be in default, and <br />the Agreement shall be rescinded. Under such circumstances, the Bidder may be prohibited <br />from submitting future bids to BSO. <br /> <br />17 <br /> <br />
