RFP #:24-08-01 <br />Proposer: Midtown Towing of Miami, Inc. <br />All copies shall be legible, and original forms provided as requested. <br />20 — ETHICS AND CONDUCT: <br />Midtown Towing shall conduct its business in an orderly, ethical and business -like manner at all times and shall use <br />every means to obtain and keep the confidence of the motoring public. All public conduct shall be in a courteous <br />and orderly manner. <br />Midtown Towing shall not divulge and information which is exempt from disclosure regarding a towed vehicle <br />when such vehicle has a "Police Hold" from the Police Department. <br />21 — COMPLAINTS AND CONDUCT: <br />Complaints received by the City concerning a violation of this Agreement, including but not limited to, misconduct <br />on the part of Midtown Towing, such as excessive charges, poor business practices, or damage to vehicles, shall be <br />referred to the City Manager and City Attorney. The City shall notify Midtown Towing of any complaints within five <br />(5) business days from the receipt of the complaint. Midtown Towing shall respond and provide any additional <br />explanation for information with respect to the particular complaint within five (5) business days upon receipt of <br />the complaint. A written disposition of the complaint will be forwarded to Midtown Towing and the complainant <br />upon completion of the investigation. If three (3) or more substantiated complaints are filed with the City of Sunny <br />Isles Beach within ninety (90) days, the City Manager may suspend Midtown Towing's permit for a period of not <br />more than thirty (30) days with no reduction in the permit fee. The towing services shall be reassigned to the next <br />Permit Holder in the rotation, as provided in the City's Administrative Regulations 110-6. <br />22 — EMPLOYEES OF MIDTOWN TOWING: <br />A copy of each employee's Driver License shall be kept on file by Midtown Towing and made available to the Police <br />Department. All personnel operating wrecker/tow trucks shall be qualified and experienced in handling <br />equipment(s) safety on the scene and transporting the vehicles. <br />23 — UNDERWATER RECOVERY SALVAGE DIVERS: <br />Midtown Towing understands that all divers must be SCUBA certified. For every diver, duty time shall be <br />computed from the time of arrival at the scene to the time the vehicle or property is rigged and hoisted to dry <br />land. <br />24 — INSPECTIONS AND AUDITS: <br />Midtown Towing understands that our records, equipment, personnel, office and storage facilities will be subject <br />to periodic checks and audits by properly designated representatives of the City without prior notice to Midtown <br />Towing. <br />All records/trucks used for towing under this agreement shall be inspected by Midtown Towing's mechanic once <br />per month.
