<br /> <br />HB 301 2025 <br /> <br /> <br /> <br />CODING: Words stricken are deletions; words underlined are additions. <br />hb301-00 <br />Page 19 of 80 <br />F L O R I D A H O U S E O F R E P R E S E N T A T I V E S <br /> <br /> <br /> <br />created pursuant to s. 768.28(16), formed and controlled by 451 <br />counties or municipalities of this state to provide liability 452 <br />insurance coverage for counties, municipalities, or other public 453 <br />agencies of this state, which pool may contract with other 454 <br />parties for the purpose of providing claims administration, 455 <br />processing, accounting, and other administrative facilities. 456 <br /> (15) Notwithstanding any other provision of this section 457 <br />or of any other law except s. 361.14, any public agency of this 458 <br />state which is an electric utility, or any separate legal entity 459 <br />created pursuant to the provisions of this section, the 460 <br />membership of which consists only of electric utilities, and 461 <br />which exercises or proposes to exercise the powers granted by 462 <br />part II of chapter 361, the Joint Power Act, may exercise any or 463 <br />all of the following powers: 464 <br /> (k) The limitations on waiver in the provisions of s. 465 <br />768.28 or any other law to the contrary notwithstanding, the 466 <br />Legislature, in accordance with s. 13, Art. X of the State 467 <br />Constitution, hereby declares that any such legal entity or any 468 <br />public agency of this state that participates in any electric 469 <br />project waives its sovereign immunity to: 470 <br /> 1. All other persons participating therein; and 471 <br /> 2. Any person in any manner contracting with a legal 472 <br />entity of which any such public agency is a member, with 473 <br />relation to: 474 <br /> a.
