Russo <br />10805 Collins Avenue, Sunny Isles Beach, Florida <br />City Manager <br />Mauricio Betancur <br />Dear Mr. Cronk, <br />City Clerk, CMC <br />The City of Sunny Isles Beach ("City") is in receipt of your correspondence dated <br />July 28, 2020, referencing your June 5, 2020 correspondence, wherein Romacorp, <br />Inc. alleges that the Lease Agreement is terminated, and improperly attempts to <br />shift Romacorp, Inc.'s contractual obligations to the City. <br />As indicated in the City's correspondence of July 20, 2020, the City rejects the <br />proposed lease termination by Romacorp, Inc.; therefore, any and all obligations of <br />Romacorp, Inc., under the Lease Agreement, remain in full force and effect, <br />including but not limited to Section 2.3 providing that Romacorp, Inc. shall pay the <br />applicable insurance premiums, and Article V requiring that Romacorp, Inc. carry <br />and maintain, at its sole cost and expense, the types and amounts of insurance <br />provided therein, including property damage insurance, covering "all risk", for "full <br />replacement value". <br />Therefore, the City expects that Romacorp, Inc., will comply with its obligations <br />under the Lease Agreement and continue to carry and maintain the types and <br />amounts of insurance identified in Article V of the Agreement. <br />Thank you for your consideration and anticipated cooperation in this regard. <br />Sincereiv., <br />Y�` <br />Chrfistopher .
