c. The Initial Term of the Lease shall be for a period of five (5) years, with the option to <br />extend the Lease for three (3), five (5) year Additional Terms, as further described in <br />Section 8 hereof, with the Initial Term commencing on the first day of the month <br />following approval by both the City and County Commission and execution of this <br />Lease by both parties. This Lease is subject to the terms and conditions contained <br />herein. <br />2. Obligations of the City. <br />a. City's Maintenance Obligations. City shall be responsible at its sole cost and expense <br />for the structural maintenance of the Government Center building, grounds, parking <br />lot, inclusive of the HVAC mechanical systems, but not including painting and repair <br />of interior partitions and walls, or repair and replacement of flooring within the Library. <br />b. Parking. Employees and visitors to the Library shall continue to enjoy free parking as <br />is currently available in the City's parking lot. Should the City change their parking <br />policies in the City Hall parking lot to metered or requiring payment for parking, <br />employees of the Library shall be provided with free parking, or, provided with parking <br />rates in accordance with rates provided to employees of the City. <br />c. Potential New Library Entrance. The City may seek to establish a new dedicated library <br />storefront entrance. Should the City establish a new dedicated library storefront <br />entrance, the City will be responsible for the costs of the design, construction drawings, <br />permitting, and selection and oversight of the contractor(s) to complete the work, <br />subject to coordination with, and prior written approval of, the project design and scope <br />by the County, including any subsequent proposed changes. <br />3. Obligations of the County. <br />a. County's Maintenance Obligations. The County shall, during the term of the Lease, be <br />responsible for maintenance, repair, and capital improvements for the interior of the <br />Library ("within the four walls") at its sole cost and expense. <br />b. Utilities and Insurance. The County shall be responsible for payment of its electric and <br />water usage, as measured by the separate meters furnished and installed by the City. <br />The County shall also reimburse to the City its pro -rata share (17.2056 percent) of the <br />City's insurance policy expenses relating to the Government Center. <br />c. Janitorial. The County shall use the janitorial and custodial services secured by the City <br />for the Government Center and shall pay the City for the pro -rata share (9.4523 percent) <br />of the cost of such services as measured by the combined square footage of the Library <br />space and a portion of the lobby restrooms and lobby entrance (8,815.96 sq ft) relative <br />to that of the entire Government Center Complex (93,268 sq ft). <br />d. Furniture, Supplies & Equipment. The County shall provide all furniture, shelving, <br />books, window treatments, supplies, and equipment, including computer and <br />telecommunications equipment, for the Library, and shall have full discretion in the <br />selection and approval thereof. <br />2025 SUNNY ISLES LIBRARY INTERLOCAL LEASE AGREEMENT <br />318 <br />MDC009 <br />
