Therefore, the proposed <br />site plan amendment resolves the vehicular conflicts and has been approved by the County; <br />(2) Roof Coverine. A solid roof instead of a trellis covering will be built to screen <br />the cars parked on the top deck; <br />(3) Relocation of Bus Stop. The bus stop is proposed to be relocated along with the <br />creation of a passenger drop off area; and <br />(4) Undergroundine of Utilities. The approved site plan requires the Applicant to <br />underground utilities on the south boundary of the Property to Collins Avenue (Condition No. 17 <br />of the Resolution). However, as you know, there is an existing gas station located directly east <br />of the Applicant's south boundary line, and the Applicant does not have the legal authority to <br />enter and do work on that property. Such entry would require the consent of the gas station <br />owner, which consent has not been obtained. Therefore, it is proposed that Condition No. 17 of <br />the Resolution be modified to provide that the Applicant would agree to underground utilities <br />only along the southern boundary of the Property. <br />In order to effectuate this proposal, the Applicant respectfully requests the following site <br />plan modification approval adopting the entitled "Sunny Isles Publix" as prepared by Fisher & <br />Associates, for the Publix Super Market. We submit that the requested approval is consistent <br />with the provisions of the City's Comprehensive Plan and LDRs. <br />Thank you for your consideration of this application.
