Summary Minutes: Regular City Commission Meeting September 17, 2015 City of Sunny Isles Beach, Florida 7. ORDINANCES FOR FIRST READING 7A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida. Amending Ordinance No. 2014 -436; Amending the City's Budget No. BA1415 -05 for the 2014 -2015 Fiscal Year - General Fund, Streets Maintenance Fund, Building Fund, Public Art Trust Fund, Capital Projects Fund, and Stormwater Operations Fund; Authorizing the City Manager to Do All Things Necessary to Implement the Terms and Conditions of this Ordinance: and Providing for an Effective Date. Action: City Clerk Hines read the title, and Finance Director Audra Curts -Whann reported noting that hopefully this will be the final budget amendment for the 2014 -2015 fiscal year. It has several purposes, and the reason it covers all the funds is it is applying the COLA that was awarded earlier in the year, taking that budget out of the Human Resources Department and applying it across the board to all the departments where those funds went. We are making sure that all the budgetary needs for the year for closing out for audit are handled. In the Capital Projects Fund one project was postponed due to other work that was being completed prior to that and so those funds were redirected to where they were needed. Also, we did not budget for the Public Art Trust Fund proceeds that arrived, and so we appropriated those funds to allow expenditure or camlover of those funds to the new budget. Public Speakers: None Vice Mayor Gatto moved and Commissioner Levin seconded a motion to approve the proposed Ordinance on first reading. The motion was approved by a roll call vote of 5 -0 in favor. Second reading, public hearing will be held on Thursday, October 15, 2015, at 6:30 p.m. Vote: Commissioner Aelion yes Commissioner Goldman yes Commissioner Levin L Vice Mayor Gatto ves Mayor Scholl ves Mayor Scholl said before we hear Item 713, Commissioner Aelion just read a newspaper article about going green, and he wants to compliment staff because they installed on his iPad a new agenda software today. He is now using both the agenda book and his iPad. Next time he is hoping we can dispense with the book, save trees, and stick with the software. 7B. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending Section 265 -45(E) of the City Code to Clarify Height of Walls and Fences in the Back Yard Area; Providing for Severability; Providing for Repeal of Conflicting Provisions; Providing for Inclusion in the Code; and Providing for an Effective Date. Action: City Clerk Hines read the title, and Planning and Zoning Administrator Claudia Hasbun reported this Ordinance is as a result of new FEMA regulations that effect single - family homes. It provides for a fence or a wall to be measured from the property grade instead of from the street so that they can have a meaningful fence in their backyard. Public Speakers: None 3
